Bayer HealthCare is facing a number of Essure complaints, from women and their families alleging serious personal information.
There have been thousands of Essure birth control lawsuits filed in the United States alone, with just as many women filing Essure complaints in Canada.
Recently over a dozen Essure birth control lawsuit have been approved to progress in the California state system, after earning approval from Superior Court Judge Winifred Y. Smith.
This was a major victory for the Essure birth control litigation, as a number of similar Essure complaints were dismissed due to preemption laws.
These Essure birth control lawsuits each involved women who suffered serious injuries allegedly due to the defective nature of the birth control device.
Bayer HealthCare had tried to dismiss the Essure birth control lawsuits, but was denied by Judge Smith.
Bayer HealthCare is also facing problems north of the border, as over 100 women in Canada have joined an Essure birth control class action lawsuit seeking legal action against the manufacturer.
Overview of Essure Birth Control Complaints
The majority of these Essure complaints stem from the device either failing, breaking apart, migrating out of place, or embedding into different areas other than the implantation site.
The Essure birth control device consists of two metal coils, each of which are implanted in each fallopian tube. The surrounding tissue of the coils eventually swell, which is meant to permanently block sperm to egg conception.
At this time, the Essure birth control device is the only non surgical female sterilization available in the United States and seems to be highly preferred to traditional tubal ligation. Not only is the Essure birth control less invasive, it requires almost no recovery time compared to traditional female sterilization.
Originally developed by Conceptus Inc., the Essure birth control was approved by the FDA in 2002 and has since been implanted in thousands of women.
But since its approval, there have been over 5,000 Essure complaints submitted by women who allegedly suffered adverse reactions.
After Bayer HealthCare had acquired the rights to the Essure birth control, the company has received numerous customer complaints and FDA safety notices regarding the devices.
The FDA is requiring Bayer HealthCare to conduct a post market surveillance study, to adequately determine the device’s safety profile.
While the company acknowledged the Essure complaints filed by injured patients, the company is yet to admit to any cause and effect relationship between the device and the complications.
Furthermore, Bayer HealthCare insists that the Essure birth control is completely beneficial to the patient population and fully intends to cooperate with the FDA.
Women who suffered complications from these devices may be able to file their own Essure complaints. Potential claimants should contact a specialized lawyer to determine eligibility for an Essure birth control lawsuit.
In general, Essure lawsuits are filed individually by each plaintiff and are not class actions.
