A new class action lawsuit alleges e.l.f. Cosmetics Inc. deceptively sells its lip gloss and exfoliant products in oversized containers that do not reasonably inform consumers that they are up to half empty.
Plaintiff Geneva Gonzales filed the class action complaint against e.l.f. Cosmetics Inc. on Feb. 25 in a California federal court, alleging violations of state consumer laws.
Gonzales claims e.l.f. Cosmetics sells its Holy Hydration! Gentle Peeling Exfoliant and Glossy Lip Stain products in containers that are up to 50% empty.
“Defendant dupes unsuspecting consumers across America to pay premium prices for empty space,” the e.l.f. Cosmetics class action alleges.
Gonzales argues e.l.f. Cosmetics markets the products in a “systematically misleading manner” by representing them as adequately filled when, in fact, they contain an unlawful amount of empty space or non-functional slack-fill.
e.l.f. Cosmetics allegedly sells products in oversized containers
Gonzales claims e.l.f. Cosmetics unlawfully underfills the products and that the front of the packaging lacks information to inform consumers of the quantity relative to the size of the containers.
“Defendant underfills the Products to save money and to deceive consumers into purchasing the Products over its competitors’ products,” the e.l.f. Cosmetics class action says.
Gonzales wants to represent a California class of consumers who purchased e.l.f. Cosmetics products containing non-functional slack-fill within the past four years.
The plaintiff demands a jury trial and requests declaratory and injunctive relief and an award of compensatory and punitive damages for herself and all class members.
In 2020, e.l.f. Cosmetics faced a class action lawsuit alleging it falsely marketed its foundation products as oil-free when they actually contained oils.
