A New York couple has filed a Durom hip implant lawsuit against the makers of the husband’s hip implant, Zimmer-Biomet, saying that the medical device was defective.
Plaintiffs Paul S. and Brenda S. have filed a products liability Durom hip implant lawsuit against Zimmer-Biomet claiming that Paul’s hip implant containing the component, a Durom Acetabular Component, caused him significant injuries.
According to his Durom hip implant lawsuit, Paul was implanted with Zimmer’s Durom cup in November 2006. Implants such as this should last up to twenty years, but he was forced to undergo revision surgery in July 2014, less than eight years later.
His physician believed that the implantation of the Durom cup in the original surgery would provide Paul with greater mobility, stability and range of motion than other hip implants on the market. Paul also believed that his life would be greatly improved by this surgery, he states in this Durom hip implant lawsuit.
Paul claims that these multiple surgeries resulted in significant injuries, including great pain and agony. These injuries, he says, have greatly hampered his ability to enjoy life and engage in activities he has normally enjoyed. Paul also alleges he has suffered “various physical manifestations of extreme emotional distress as a result of needing a subsequent revision surgery.”
After the initial surgery, Paul began to experience extreme leg and hip pain, he reports, that disallowed him to perform basic physical motions like sitting for a period of time and bending at the hip.
According to this Durom hip implant lawsuit, Paul could never have known until the time he had to undergo revision surgery that the Zimmer Durom cup was the reason behind his injuries and pain.
The plaintiffs are bringing forth claims against Durom hip manufacturer Zimmer-Biomet of failure to warn and instruct, design defect, manufacturing defect, negligence, negligent misrepresentation, intentional misrepresentation, breach of implied warranty, breach of express warranty, constructive fraud and loss of consortium.
Durom Hip Implant Complications
Just two years after the Zimmer Durom cup hip implant system was released, it was recalled.
The Durom Acetabular Component is a part of one of Zimmer’s hip implant systems. The Durom Acetabular cup was designed to provide a maximum range of motion and to last longer than traditional hip implants.
The Durom cup is made of forged metal and was intended to be harder, smoother and more durable than the cast metal of previous metal-on-metal hip implants. Forged from a singular piece of chromium and cobalt alloy metal, it was approved by the U.S. Food and Drug Administration in 2006 and nearly 13,000 devices were implanted.
Within one year of the device approval, complications began to be reported. By 2010, the Durom cup was no longer being used because of issues it caused in patients. Extreme pain, device loosening and dislocation are among the problems reported by patients and cited in lawsuits.
This Durom cup hip implant lawsuit is Case No.2:17-cv-04976-SDW-SCM in the United States District Court for the District of New Jersey.
