Dr. Praeger’s Frozen Food Class Action Settlement

The Dr. Praeger’s settlement will resolve a class action lawsuit, entitled Elias v. Ungar’s Food Products, that alleges Ungar’s and Sensible Foods misrepresented the amount of fat and calories represented on the packages of Dr. Praeger’s California Veggie Burgers, Tex-Mex Veggie Burgers, Broccoli Pancakes, Potato Pancakes and Spinach Pancakes. Both companies deny any wrongdoing, but have agreed to a $1.352 million class action lawsuit settlement to avoid the expense of ongoing litigation.
Class Members of the Dr. Praeger’s class action settlement include all U.S. residents who purchased Dr. Praeger’s California Veggie Burgers, Tex-Mex Veggie Burgers, Broccoli Pancakes, Potato Pancakes and Spinach Pancakes from May 30, 2000 through August 31, 2007. As a Class Member, you’re entitled to one of the following class action settlement benefits:
(I) Claimants with Valid Proof of Purchase – Class Members who submit a valid and timely claim form with Proof of Purchase can recover the amount of money they paid for the products, excluding sales tax and any coupons or discounts and shipping and handling charges, and excluding Internet purchases.
(II) Claimants Who Made Internet Purchases – Class Members who purchased the covered products through the www.drpraegers.com website during the Class Period can recover the amount of money they paid for the products, excluding sales tax and any coupons or discounts and shipping and handling charges if they submit a timely and valid claim form.
(III) Claimants Who Contacted Class Counsel – Class Members who contacted Class Counsel during the pendency of the case, prior to March 9, 2012, as verified by Class Counsel, and who submit a valid and timely claim form with affidavit, can recover the amount of money they for the products during the Class Period, excluding sales tax, any coupons or discounts, and shipping and handling charges, and excluding any recovery obtained through the other two (2) claimant groups.
In the event that the total Direct Compensation paid to Class Members identified in the groups above is less than the Total Settlement Benefits, Defendants will offer each of the products at a discount of at least $1-off each register scan per package sold at 20 select retail locations during each of up to four months in an 18-month period selected by Defendants to commence in 2012. If any settlement money is left over after that, the Defendants will make a charitable donation in the form of frozen food products and/or cash to select charities.
To receive any benefits from the Dr. Praeger’s false advertising class action settlement, you must submit a valid claim form postmarked by October 15, 2012 to the Settlement Administrator.
