
Dollar Bank data breach class action lawsuit overview:

Dollar Bank failed to protect personally identifiable information (PII) inherited from customers of Standard AVB Financial Corp. after it acquired the bank in May 2021, a new class action lawsuit alleges.
Plaintiff Anna Stewart-Gower claims a data breach that occurred between March 4, 2021, and Feb. 4, 2023, was a result of a failure by Dollar Bank to maintain reasonable security safeguards and adequately train its employees on cybersecurity.
“The exposure of one’s PII to cybercriminals is a bell that cannot be unrung. Before this data breach, customers’ private information was exactly that — private. Not anymore. Now, customers’ private information is forever exposed and unsecure,” the Dollar Bank class action states.
Stewart-Gower wants to represent a nationwide class of consumers who had their PII exposed during the data breach discovered by Dollar Bank in February 2023, including everyone who received notice of the incident.
Dollar Bank took more than two months to discover data breach, class action says
Stewart-Gower claims it took Dollar Bank more than two months to discover the data breach after it began and 116 days after it first discovered the incident to begin notifying those affected by it.
“Defendant kept the Class in the dark — thereby depriving the Class of the opportunity to try and mitigate their injuries in a timely manner,” the Dollar Bank class action states.
Stewart-Gower claims Dollar Bank is guilty of publicity given to private life, breach of fiduciary duty, breach of confidence, unjust enrichment, breach of implied contract, negligence per se and negligence.
The plaintiff is demanding a jury trial and requesting declaratory and injunctive relief along with an award of compensatory, exemplary, punitive and statutory damages for herself and all class members.
Stewart-Gower previously filed the complaint in Pennsylvania federal court in November before voluntarily dropping the lawsuit without explanation Jan. 5. The complaint was refiled earlier this month.
