A new class action lawsuit alleges Dermalogica falsely advertised its cosmetic products as being “Made in the USA.”
Plaintiff Steven Lavallee claims Dermalogica’s products are labeled with the express, unqualified representation that they are “Made in the USA” despite the fact they contain foreign ingredients.
“Contrary to Defendant’s express representations and its failure to clearly and adequately qualify those representations, the products purchased by Plaintiff are substantially and materially composed of indispensable foreign ingredients,” the Dermalogica class action lawsuit states.
Lavallee wants to represent a California class of consumers who purchased one or more of the Dermalogica products marketed or labeled as “Made in the USA” that were made with or contained ingredients or components not grown or manufactured in the United States within four years prior to the filing of the complaint.
Lavallee claims Dermalogica violated California’s Consumers Legal Remedies Act, Unfair Competition Law and False Advertising Law and breached express warranty.
Dermalogica ‘unfairly and deceptively’ misrepresented its products, lawsuit claims
Lavallee argues Dermalogica unfairly and deceptively misrepresented its products as being purely of U.S. origin.
“Most consumers have limited awareness that products — along with their ingredients and components — labeled as made in the United States may, in fact, contain ingredients or components sourced, grown or manufactured in foreign countries,” the Dermalogica class action lawsuit states.
Lavallee claims Dermalogica’s alleged false representations led consumers to believe they were purchasing products made in the United States without foreign ingredients.
The plaintiff demands a jury trial and requests declaratory and injunctive relief and an award of compensatory and punitive damages for himself and all class members.
A string of lawsuits have recently targeted “Made in USA” labeling, including brands such Mielle Organics, Paul Mitchell, Goya Foods, PepsiCo, Unilever, the Pepsi Lipton Tea Partnership, McCormick & Co. and Reynolds Wrap.
