Plaintiff Myrna S. files her DePuy ASR prosthetic hip lawsuit in Ohio federal court, joining a growing multidistrict litigation (MDL) against the company. The lawsuit was filed on April 17, 2018.

According to the DePuy ASR prosthetic hip lawsuit, Myrna, a current resident of Maryland, claims damages as a result of the serious injuries she suffered, including economic loss. She says that she was implanted with the DePuy ASR hip implant on her right hip in August 2008 at Doctors Community Hospital in Lanham, Md.

Following the device’s implantation, however, she says she suffered from severe injuries that include: “extreme pain; discomfort; soreness; malaise; swelling; loss of energy; immobilization and both acute localized damage to tissue and/or bone surrounding the acetabulum and systemic injuries…”

The DePuy ASR prosthetic hip lawsuit also claims “past, present and future medical, hospital, monitoring, rehabilitative and pharmaceutical expenses” as well as other injuries.

Myrna says that she later had the hip implant explanted due to these adverse side effects on Feb. 21, 2017. She adds that she only knew of the device’s alleged defectiveness after having her blood drawn as samples indicated she had excessive levels of chromium and cobalt.

The DePuy ASR prosthetic hip lawsuit was filed on multiple counts, including: negligence, negligence per se, defective design, manufacturing defect, failure to warn, breach of express warranty, breach of warranty as to merchantability, breach of implied warranties, fraudulent misrepresentation, fraudulent concealment, and negligent misrepresentation, among others.

Myrna demands a trial by jury. Her DePuy ASR Prosthetic Hip Lawsuit is Case No. 1:18-dp-20030-JJH, in the U.S. District Court for the Northern District of Ohio, Western Division.

Those who have filed DePuy hip implant lawsuits have complained of adverse side effects and complications including loosening, revision surgery, dislocation, and metal poisoning or metallosis.
