Recently, a DePuy ASR hip settlement was set into place to help patients who underwent hip revision surgery after March 2015.
Patients may be eligible to join the DePuy ASR hip settlement if they opted for the metal hip implant and suffered one of the following complications:
- Device failure causing need for early replacement
- Dislocated hip
- Metallosis (blood metal poisoning)
- Cancer
- Degenerative heart disease
- Loss of bone strength or structure that can result in bone fractures
- Tissue death of implant site
- Formation of pseudotumors
Depending on the severity of the metal hip implant complications and other specifications of the case, the patient could be eligible to receive thousands from the DePuy ASR hip settlement.
Patients who have to undergo revision surgery may have had to face serious and possibly life threatening complications from the medical device or other initial procedure.
Overview of DePuy ASR Hip Implant Complications
Revision surgery is often conducted to explant and replace a faulty medical device. It can place patients at a higher risk for infection. Even if the revision surgery works, patients sill have to contend with the massive medical bills that come with the procedures and rehabilitation process.
Patients joining the DePuy ASR hip settlement have allegedly suffered metal hip implant complications due to DePuy’s Orthopaedics’s metal hip implant. Johnson & Johnson is facing almost 8,000 DePuy ASR hip implant lawsuits from patients alleging the metal hip implants were defectively made and unreasonably dangerous to patients.
These patients opted for the DePuy ASR hip implant to restore hip movements, and claim they were not warned of potential device failure or metal hip implant complications. When metal-on-metal hip implants were approved and entered the market, they were thought to be superior to their ceramic or plastic counterparts.
All metal hip implants were advertised to be longer lasting and more durable, making them an ideal choice for patients wanting to live an active lifestyle. However, the all-metal ball-and-socket joints of the devices tend to fret and corrode.
This causes metal ions to be shed into the blood, leading to potential infection and often creating the need for revision surgery. Even though DePuy Orthopaedics reportedly knew about the severity of potential metal hip implant complications, plaintiffs claim the company failed to warn the public.
This has led to the formation of the DePuy ASR hip settlement, with patients filing claims alleging negligence and failure to warn. Parent company Johnson & Johnson has already agreed to settle several DePuy ASR hip lawsuits, with the company agreeing it would pay $600,000 to settle three of these claims in August 2012.
These claims allege that the plaintiffs experienced pain and bone damage, allegedly due to metal hip implant complications. Each plaintiff reportedly received $200,000 from the designated DePuy ASR hip settlement, with legal experts stating that this amount was relatively low compared to other class action awards.
Potential claimants who want to join the current DePuy ASR hip settlement should contact a lawyer to determine eligibility.
