Young female touching her right side in pain colored in redAn Oregon woman has filed a DePuy ASR hip implant lawsuit against the manufacturers of her hip implant claiming that she’s been injured as a result of a defective medical device.

Plaintiff Mary S. is a resident of Salem, Oregon. She claims that as a result of receiving a DePuy ASR hip implant, she suffered injuries, economic losses and loss of services.

Her DePuy ASR hip implant lawsuit claims that she was implanted with a DePuy ASR hip implant in her right hip on Dec. 15, 2008. However, at some point after her surgery, she began feeling as if she had sustained injury in the area of her DePuy ASR hip implant.

On Aug 29, 2017, Mary had the implant explanted, or removed.

According to her DePuy ASR hip implant lawsuit, she suffered sustained injuries as result of the DePuy device and subsequent surgery. As a result, she holds both DePuy Orthopaedics and Johnson & Johnson accountable for her pain and injuries.

Her DePuy ASR hip implant lawsuit states that she “could not have known that the injuries she suffered were as a result of a defect in the ASR hip implant until after the date the device was recalled from the market and [she] came to learn of the recall.”

Additionally, there was no way to know, she claims, that she would have been injured by excessive levels of chromium and cobalt as a result of the defective metal-on-metal hip replacement device.

According to her DePuy ASR hip replacement lawsuit, Mary believes she is entitled to recover compensatory damages for “pain and suffering and emotional distress and for economic loss as well as punitive damages.”

Mary has listed many causes of action in this DePuy ASR hip replacement lawsuit, some of which include negligence, manufacturing defect, defective design, failure to warn, breach of express and implied warranties, fraudulent misrepresentation and concealment and gross negligence/malice.

Reports Behind the DePuy ASR Hip Implant Lawsuit

The DePuy ASR hip replacement medical devices were designed to be better than previous metal hip devices. It would outperform its predecessors, according to the company. Preclinical studies showed that metal-on-metal hip implants would last longer and provide greater mobility than other types of hip replacement systems.

Metal hip implants were also meant for patients who were younger and still did many types of movement activities such as running, being designed for greater levels of friction.

Common problems associated with the DePuy ASR hip replacement system include metallosis (the poisoning of the surrounding tissue and blood, due to metal shavings), non-cancerous cysts, tissue infection and complete device failure.

DePuy and Johnson & Johnson have undergone thousands of lawsuits regarding their DePuy ASR hip implant system and in 2012, spent $3 billion to settle 3,000 lawsuits. The ASR hip system has also gone through a series of recalls by the manufacturing company.

This DePuy ASR Hip Implant Lawsuit is Case No. 1:18-dp-20016-JJH in the United States District Court of the Northern District of Ohio, Northern Division.
