A new lawsuit filed by a Kentucky man alleges that the DePuy Pinnacle hip replacement is defective and may cause serious injuries.
The plaintiff, Charles R., was implanted with a DePuy Pinnacle hip replacement device in his left hip on Aug. 25, 2008. Since the implantation, however, Charles says he has developed severe and ongoing pain in his left hip. which has worsened over time. Now, the pain has even spread to his left knee and lower back.
The consistency and severity of the pain and its effect on Charles’ mobility have begun to interfere with his everyday life, he claims. The lawsuit also claims that the metal-on-metal DePuy Pinnacle hip replacement device has led to metallosis. Charles has since developed severe kidney problems which have been connected with metallosis.
These complications eventually led to Charles’ revision surgery to remove the DePuy Pinnacle hip replacement device in October 2017. Of course, revision surgery brings with it its own risks and additional medical expenses. According to the lawsuit, Charles and hundreds of other patients implanted with the DePuy Pinnacle hip replacement have been affected by these side effects and forced to undergo revision surgery.
Soon after, on Nov. 7, Charles filed his DePuy Pinnacle hip replacement lawsuit in the U.S. District Court for the Northern District of Texas.
His DePuy Pinnacle hip replacement lawsuit was filed on multiple counts, including negligence, defective design, failure to warn, breach of express and implied warranties, negligent misrepresentation, fraudulent concealment, and others.
According to the DePuy Pinnacle hip replacement lawsuit, over 1,300 adverse event reports have been filed with the U.S. Food and Drug Administration (FDA) because of device failure or other Pinnacle implant complications.
The DePuy Pinnacle hip replacement lawsuit claims that DePuy was aware of the substantial risks linked with its hip implant, including metallosis and a high failure rate, yet failed to adequately warn patients or the medical community about these risks.
DePuy claims that 150,000 of these Pinnacle Devices have been sold, and that “99.9% of Pinnacle Hip components are still in use today.” The sheer number of devices still in use means that far more patients like Charles may still be at risk of suffering from these defects.

Unfortunately, the device has been linked with serious complications, and thousands of lawsuits have so far been filed.
