Cox Enterprises class action lawsuit overview:
- Who: Plaintiff Louise Barnes filed a class action lawsuit against Cox Enterprises Inc.
- Why: Barnes claims the company failed to protect her and other consumers’ personally identifiable information (PII) during an August 2025 data breach.
- Where: The class action lawsuit was filed in Georgia federal court.
A new class action lawsuit alleges Cox Enterprises failed to properly secure and safeguard the personally identifiable information of consumers from being stolen by cybercriminals during an August 2025 data breach.
Plaintiff Louise Barnes claims Cox Enterprises, the parent company of Cox Communications, among others, was negligent in its alleged failure to adequately protect the PII of herself and other consumers.
“This unencrypted, unredacted private information was compromised due to the defendant’s negligent and/or careless acts and omissions and its utter failure to protect the plaintiff’s and class members’ sensitive data,” the Cox Enterprises class action lawsuit says.
The claims are not the only ones affecting the Cox Enterprises family, Cox Communications is also currently dealing with claims it engaged in a bait-and-switch scheme where it charged customers more for internet and TV service plans than it had advertised and promised.
Consumers who are current or former Cox Internet or TV residential customers may be able to make a claim for monthly overcharges.
Meanwhile, Barnes wants to represent a nationwide class of individuals in the United States whose PII may have been compromised in the data breach, including anyone who received a notice from Cox Enterprises.
Cox Enterprises allegedly knew a data breach would result in identity theft risk
Barnes claims Cox Enterprises knew that any breach and exposure of the data stored within the platform would result in an increased risk of identity theft and fraud for the consumers whose PII was compromised.
Further, Barnes argues the “present and continuing risk of identity theft and fraud” will remain for the “respective lifetimes” of those affected.
“Hackers targeted and obtained the plaintiff’s and class members’ private information because of its value in exploiting and stealing the identities of the plaintiff and class members,” the Cox Enterprises class action lawsuit says.
Cox Enterprises also failed to provide those affected by the data breach with “timely, adequate notice” that it had occurred, the lawsuit alleges.
Barnes claims Cox Enterprises is guilty of negligence, breach of implied contract and unjust enrichment.
The plaintiff demands a jury trial and requests declaratory and injunctive relief and an award of compensatory, actual, statutory, nominal, exemplary and punitive damages for herself and all class members.
A consumer filed a similar class action lawsuit against DoorDash over claims the company failed to safeguard the PII of thousands of users in a recent data breach.
