CoVantage Credit Union class action overview:

Customers of Marquis Software’s financial institution clients have filed a class action lawsuit against the company and two credit unions over a data breach that allegedly exposed their personally identifying information.
Plaintiffs Kathy Yunk and Diane Dzilvelis allege that Marquis Software, CoVantage Credit Union and University Credit Union failed to properly secure and safeguard the PII of customers of Marquis Software’s financial institution clients.
According to the class action lawsuit, the CoVantage Credit Union data breach exposed customers’ names, addresses, phone numbers, Social Security numbers, financial account information, taxpayer identification numbers and dates of birth.
“Defendants owed a duty to plaintiffs and class members to implement and maintain reasonable and adequate security measures to secure, protect and safeguard their PII against unauthorized access and disclosure,” the CoVantage Credit Union class action lawsuit says.
Marquis Software allegedly delayed data breach notification
Yunk and Dzilvelis allege Marquis Software waited more than three months to announce the CoVantage Credit Union data breach and begin notifying affected individuals.
The defendants’ alleged failure to promptly notify affected individuals “virtually ensured” that unauthorized third parties who exploited the security lapses could monetize, misuse or disseminate the PII, the CoVantage Credit Union class action lawsuit claims.
“As a result, plaintiffs and class members will suffer indefinitely from the substantial and concrete risk that their identities will be (or already have been) stolen and misappropriated,” the lawsuit states.
Yunk and Dzilvelis claim the defendants are guilty of negligence, breach of implied contract and unjust enrichment and of violating the California Unfair Competition Law.
The plaintiffs demand a jury trial and request declaratory and injunctive relief and an award of monetary, statutory and punitive damages for themselves and all class members.
Meanwhile, Via Credit Union is facing a class action lawsuit alleging it failed to adequately protect the personal information of more than 60,000 customers during a data breach discovered earlier this year.
