A New York couple has filed an Invokana kidney failure lawsuit against the makers of the popular type 2 diabetes drug.
Plaintiff Bernadette D. began taking Invokana for her type 2 diabetes in January 2015. She did so under the assumption that Invokana was safe for use.
According to her Invokana kidney failure lawsuit, Bernadette began taking Invokana to reduce her blood sugar. She did not know that Invokana could cause severe adverse effects such as kidney failure.
Bernadette suffered from kidney failure, she claims, as a direct and proximate result of taking Invokana. She alleges that the manufacturers of Invokana, Janssen Pharmaceuticals, knew or should have known of the risks associated with Invokana and that it can cause severe kidney damage.
She believes, according to her Invokana kidney failure lawsuit, that Janssen had data available to them that should have informed them that complications like ketoacidosis, kidney failure and other serious complications could occur.
Additionally, a condition like ketoacidosis can lead to complications such as cerebral edema, pulmonary edema, cerebrovascular accident, myocardial infarction, nonspecific myocardial injury, severe dehydration and coma.
Bernadette believes that despite Janssen’s knowledge of the risks of their drug, they failed to adequately warn consumers and physicians about the risks associated with Invokana, did not conduct proper studies to look at the possible side effects and continued to promote and market their drug as safe and effective.
The second plaintiff, James D., was also prescribed Invokana. However, not long after he began taking it, according to this Invokana kidney failure lawsuit, he developed diabetic ketoacidosis.
Couple Seek Damages From Drug Maker in Invokana Kidney Failure Lawsuit
Both Bernadette and James have suffered from pain and suffering, emotional distress, loss of enjoyment of life and economic loss including significant expenses for medical care and treatment. They are seeking actual, compensatory and punitive damages from Janssen.
The plaintiffs allege that their injuries were preventable and resulted from the defendants failure to conduct safety studies, failure to assess and publicize safety signals, suppression of revealing information, willful and wanton failure to provide adequate instructions as well as willful misrepresentations of the nature and safety of Invokana.
They both claim they would not have used the drug had they known the risks.
Even though several times the Food and Drug Administration issued safety warnings regarding Invokana and other drugs in the same class and Health Canada released similar information regarding the severe problems associated with Invokana, the drug label still does not contain a proper warning.
Instead, according to the Invokana kidney failure lawsuit, Janssen continues to aggressively market and promote their unsafe drug.
The Invokana Kidney Failure Lawsuit is Case No. 3:17-cv-00750 in the U.S. District Court for the District of New Jersey, Trenton Division.
In general, Invokana lawsuits are filed individually by each plaintiff and are not class actions.
