In a recent lawsuit, plaintiffs Robert and Joan G. say that Robert began taking Actos to manage his type-2 diabetes. Robert alleges that he developed bladder cancer on or around September 2016, and claims that this was a direct result of his use of Actos.
He says that Takeda Pharmaceuticals knew that the drug could cause cancer, and did not notify patients of physicians intentionally so they could continue selling the drug. The couple says that had they known that Actos could cause bladder cancer, Robert would have chosen another medication to manage his diabetes.
The couple seeks to hold Takeda Pharmaceuticals liable for Robert’s physical, emotional and financial injury. They also hope to hold Takeda liable for their loss of consortium, loss of society, affection, assistance, and conjugal fellowship as a result of Robert’s physical injury. Robert and Joan say that their marital relationship has suffered as a result of John’s injuries from bladder cancer, and aim to hold Actos liable for these injuries.
According to Robert, he suffered physical, emotional, and financial injury by taking Actos. The Actos lawsuit alleges that Takeda’s misrepresentations of the drug led to Robert’s cancer. He says that he requires and will require ongoing medication and treatment to deal with his bladder cancer.
Additionally, he says he has suffered serious mental and physical pain and suffering, and has, and will continue to sustain permanent injuries and emotional distress because of his bladder cancer. Robert says that he has also had to incur medical costs and increased cost of living expenses related to his bladder cancer.
According to the Actos bladder cancer lawsuit, Takeda Pharmaceuticals did not provide adequate warnings and instructions to patients about the drug’s potential dangers. The link between Actos and bladder cancer has been well-documented in research, alleges the lawsuit, but this link was entirely omitted in information about the drug. Specifically, Robert alleges that the information he an his physicians received about the drug did not contain mention of the drug’s alleged link to bladder cancer.
Allegedly, Takeda not only misrepresented the safety of Actos to patients and physicians, but to the Food and Drug Administration. The Actos bladder cancer lawsuit cites numbers studies that allegedly link Actos use with the development of bladder cancer. It points out that there was a study conducted that showed Actos use was linked to cancer in rats, and the results of this study were available before the drug was approved by the FDA in 1999. Additionally, multiple studies since the drug’s approval have allegedly linked the drug to bladder cancer, but Takeda continued to market the drug as safe and effective.
