Old Navy sale sign clothing clothesShoppers at Old Navy stores, owned by Gap Inc., say that they are purposely misled into purchasing items that are full price based on misleading advertisements that do not clearly state that certain items were not included as part of the sale.

According to these reports, Old Navy misleading ads allegedly advertise items that appear to the average customer to be on sale based on email and in-store advertisements. The advertisements apparently don’t specify which items are discounted and which others aren’t.

Sometimes, it is not until the customer has decided to make a purchase and is paying for the item at the cash register that they are told that the item they intend to purchase is not a part of the advertised sale.

With email marketing and advertisements, the Old Navy misleading ads reportedly have small print at the bottom of the email that indicates “Select styles only,” but consumers say it is unclear which styles are and are not included in the sale price.

In the stores, the same wording appears on the signage of the Old Navy misleading ads indicating “Select styles only.” The signs also state “Discount taken at register.” Customers are required to go to the cash register with the intent of making the purchase before the price is revealed, causing a great deal of frustration for shoppers.

Old Navy Misleading Ads Prompt Class Action Lawsuit

Consumers fed up with Old Navy misleading ads took matters into their own hands and filed a misleading advertisement class action lawsuit against Gap Inc. The plaintiffs in this legal action said that the company knew that Old Navy sales would entice consumers to visit the store where they would spend their time shopping for clothing, trying the items on and a fitting room and waiting in line to purchase their items.

In this way, consumers become invested in these items after having spent so much time and energy searching for the items, trying the items on and waiting for the cashiers that when they find out that the item is actually not on sale due to the Old Navy misleading ads, they end up buying the item anyway because all of the time and energy that went into the process.

Consumers who made an in-store purchase at a retail Old Navy location or who made an online purchase at Old Navy while being located in California during the previous four years may be eligible to participate in a class action lawsuit investigation over Old Navy misleading ads.

These consumers must have shopped at Old Navy and purchased an item after seeing it advertised on sale, but in the end, found out that the item was not actually on sale due to Old Navy misleading ads. Consumers must not have an Old Navy, Gap or Banana Republic brand credit card in order to potentially qualify for this investigation.

Consumers who go on to file class action lawsuits may be eligible to receive financial compensation for their losses, and lead plaintiffs in class action lawsuits may be eligible for a service award for representing other plaintiffs in the Class. In addition to receiving financial compensation, eligible plaintiffs can also seek to hold companies accountable for engaging in proper advertising practices that do not deceive consumers or violate any consumer protection laws.
