Gryphon Healthcare class action lawsuits overview: 

  • Who: Consumers separately filed three class action lawsuits against Gryphon Healthcare LLC. 
  • Why: They class action lawsuits claim Gryphon Healthcare failed to properly secure and safeguard the personally identifiable information and protected health information of its customers during a data breach.
  • Where: The class action lawsuits were filed in Texas federal court.

Gryphon Healthcare failed to properly secure and safeguard the personally identifiable information and protected healthcare information of customers during a data breach the company says it discovered in August, a trio of new class action lawsuits allege. 

The class action lawsuits argue the Gryphon Healthcare data breach compromised highly sensitive data, with two of the complaints arguing the exposed information represents a “gold mine for data thieves.” 

“Defendant failed to adequately protect plaintiff’s and class members’ private information––and failed to even encrypt or redact this highly sensitive information,” one of the Gryphon Healthcare class actions says. 

The consumers behind the class action lawsuits each want to represent a nationwide class of all individuals whose private information the hackers accessed and/or acquired/compromised as a result of the data breach, including those who were sent a data breach notice. 

Gryphon Healthcare waited to disclose data breach, class actions claim

Gryphon Healthcare waited until on or about Oct. 11, 2024, roughly two months after the company said it became aware of the data breach, to notify affected current and former patients their private information had been compromised, the Gryphon Healthcare class actions allege. 

“Gryphon was at all times fully aware of its obligation to protect the private information of its patients yet failed to comply with such obligations,” the Gryphon Healthcare class actions say.

The Gryphon Healthcare class actions collectively claim the company is guilty of unjust enrichment/quasi contract, breach of third-party beneficiary contract, negligence and negligence per se, invasion of privacy, breach of confidence, breach of fiduciary duty and breach of implied contract. 

The plaintiffs each demand a jury trial and request declaratory and injunctive relief and awards of actual, compensatory, statutory and punitive damages for themselves and all class members. 

A consumer filed a similar class action lawsuit against UnitedHealthcare earlier this year over claims the health care and well-being company failed to secure the PII and PHI of consumers during a February 2024 data breach.
