All day energy greensA class action lawsuit has been filed against Bactolac Pharmaceuticals Inc. by consumers who claim that its All Day Energy Greens drink was touted as being an “all natural energy drink,” but it instead was a dangerous mixture that could result in serious illness or even death.

Plaintiffs Jeffrey Faris says he purchased canisters of All Day Energy Greens directly from NaturMed in 2014 and 2015. He claims that he purchased the dietary supplement to improve his health and relied on the representations from the defendant that the product was safe and effective.

Faris goes on to say he did not receive any health benefits from consuming the All Day Energy Greens beverage.

Plaintiff Antonia Hamilton alleges that she also purchased the All Day Energy Greens product, hoping it would improve her health. She says she relied on the representations that the product was safe.

After she consumed the product, Hamilton argues that she started to experience abdominal pain and discomfort in addition to other symptoms of gastrointestinal illness. She notes the symptoms of her illness were so significant that she sought treatment from numerous physicians.

The NaturMed class action lawsuit alleges that the defendants knew that their dietary supplements contained harmful substances, but did not inform consumers of this fact, even after the information regarding the dangers of the product became known to the defendant.

The plaintiffs maintain that the defendant started receiving complaints as early as September 2014, stating customers were becoming seriously ill after taking the supplements, but the company continued to sell and market the product.

Woman with stomach acheThe defendants finally recalled the product on March 18, 2016, 18 months after they started to receive complaints that the drink was causing their customers to become ill.

The All Day Energy Greens class action lawsuit argues that the plaintiffs did not receive the benefit of their bargain and did not receive a product that met their expectations.

The defendants touted their products as healthy and that it was “passionate about helping people improve their health so they can enjoy their life to the fullest” and claimed that their products “reflect our belief that nutritional support is a key component to achieving lifelong health,” according to the NaturMed class action lawsuit.

The All Day Energy Greens was a powdered vegetable dietary supplement sold in canisters. Each canister was a one month supply of the product which was to be consumed daily, the plaintiffs claim.

In addition, NaturMed stated that the All Day Energy Greens were promoted as being “one of the most potent, energizing, immune-enhancing drinks available,” the plaintiffs maintain.

The class action argues that the All Day Energy Greens product was made with ingredients that did not equal the ingredients set forth on the label.

“Because All Day Energy Greens were manufactured using ingredients not identified on the product label, or in the product formula, the product was adulterated and/or misbranded,” alleges the diet supplement class action lawsuit.

The plaintiffs also state that at no time during 2014 and 2015 did NaturMed inform its customers that the product may cause gastrointestinal illness and at no time during those years did the company attempt to recall the products due to the deleterious effects on customers’ health.

After finally issuing a recall in 2016, NaturMed sent letters to consumers stating that “a voluntary recall has been initiated as a precaution due to some reported cases of gastrointestinal distress possibly associated with consumption of a product you purchased from us,” claims the NaturMed class action lawsuit.

But in reality, “All Day Energy Greens” were hazardous for humans to consume and could cause “severe, chronic illness, bodily impairment, and death,” which was not disclosed to the company’s customers.

In addition, the plaintiffs aver that NaturMed did not publicize the recall either on its website nor on publicly available print or online resources.

The defendants are allegedly in violation of the Arizona Consumer Fraud Act, New York General Business Law, the Florida Deceptive and Unfair Trade Practices Act, the Washington Consumer Protection Act, Fraudulent Concealment, Negligent Misrepresentation, and Unjust Enrichment.

Prospective Class Members include: “All persons in the United States who purchased one or more canisters of All Day Energy Greens from one of the 99 lots that were recalled by NaturMed on March 18, 2016.”

    I loved your product for years ,I felt great for a long time in the beginning. How after 10 years of daily use I now have iron poisoning.
    My Dr. said I. Lucky to only have that. I feel awful I’ve convinced my friends to take it. I’m saddened it turned out this way. I put a spoonful in my coffee daily.

    I used ivl for 3years. I started having Heart burn, everyday. I thought it was stress from work. I stop using your product. My heart burn, subsided. I realized that IVL was causing it. I didn’t realize till now.

    please contact me about the law suit. I consumed the All day energy green supplement for years. Not knowing it was dangerous.
