An Air France Premium Economy class action lawsuit was filed recently, claiming that despite the company’s advertising that the seats are 40 percent roomier than those in the economy class, they are not that much bigger. The Air France Premium Economy class action lawsuit was initiated by plaintiff Abraham Hakimi as a class action claim on behalf of himself and all others similarly situated.
Hakimi’s Air France Premium Economy class action lawsuit alleges breach of contract, breach of the implied covenant of good faith and fair dealing, unjust enrichment, breach of contract implied and breach of contract express. The class action lawsuit alleges that Air France is misleading consumers about the space provided in these particular seats and causing them to pay a premium as a result.
As airlines have increasingly become crowded and smaller, many people choose to pay for premium seat choices in order to get additional space and for customers to enjoy a more comfortable ride. When consumers find out that paying that additional premium has not gotten them the bigger seat they were led to expect, this can lead to lawsuits.
According to the Air France Premium Economy class action lawsuit, the company purports that the premium economy seat gives 40 percent more space than the traditional economy cabin space. Since 2009, according to the defendants’ marketing materials, the premium economy cabin has been giving customers a more comfortable way of traveling for pleasure or for business in a separate cabin and at affordable prices.
More than 2.5 million customers have sat in these seats since the initial launch. However, the Air France Premium Economy Class Action Lawsuit says that this information is misleading because it is not accurate.
According to Hakimi, the economy class seat pitch is 32 inches and the premium economy seat pitch is just 38 inches. The width of the traditional economy seat, according to an investigation shared within the Air France Premium Economy Class Action Lawsuit, is just 17 inches, whereas the premium economy seat only has two additional widths.
Many different consumers have complained about the size of the seats, including the plaintiff who initiated this Air France Premium Economy class action lawsuit. The Air France Premium Economy class action lawsuit says that the defendants knew or reasonably should have been aware that the seats in the premium economy cabin did not provide the 40 percent greater space to the customer than those in the economy cabin, as was argues in their marketing material.
In 2014, Hakimi says he purchased an airline ticket on Air France in the premium economy cabin to travel from Paris to Los Angeles. He alleges he paid additional funds to sit in the premium economy section and discovered that the seat was much smaller than expected.
