Bristol-Myers Squibb Company and Otsuka Pharmaceuticals Co., Ltd., both face a woman’s recent compulsive behavior and Abilify lawsuit alleging the drug caused her to develop a compulsive disorder leading to physical injury and monetary injuries.
Plaintiff Denise M. is filing the compulsive behavior and Abilify lawsuit in Florida federal court joining a growing multidistrict litigation (MDL) against the companies.
Denise filed the compulsive behavior and Abilify lawsuit on Feb. 28, 2018.
According to the lawsuit, Denise, a resident of the state of California, says that she began taking Abilify from approximately 2006 until 2015.
However, she began to suffer serious monetary and physical injuries from having been prescribed Abilify, she claims. According to the lawsuit, Denise suffered serious bodily injury including mental anguish, loss of capacity for the enjoyment of life, pain and suffering, and disability.
The lawsuit further states that she suffered monetary damages including the loss of earnings, loss of the ability to earn money and economic losses.
The compulsive behavior and Abilify lawsuit was filed on multiple counts including strict liability, breach of express warranty, breach of implied warranty, negligence, negligence per se, negligent misrepresentation, Violation of Consumer Protection Laws, fraudulent concealment, loss of consortium and punitive damages.
Compulsive Behavior and Abilify Facts
According to the U.S. Food and Drug Administration (FDA), Abilfy treats different disorders ranging from schizophrenia, irratibility associated with autistic disorder, Tourette’s disorder, major depressive disorder and bipolar I disorder.
The MDL currently filed against the companies alleges that Abilify causes serious compulsive disorders such as compulsive eating, gambling, and urges to have sex and shop.
Accusations include failing to report these serious adverse effects linked to Abilify. To compensate for their physical injuries and monetary damages, consumers may file compulsive behavior and Abilify lawsuits for relief.
Other adverse effects associated with Abilify in addition to compulsive behaviors may also include some of the following: vomiting, constipation, blurred vision, dizziness, restlessness, insomnia, headaches and nausea.
Many studies have linked Abilify to compulsive gambling side effects. Studies have been correlating this adverse side effect since 2010. Additionally, because of a “reasonable evidence of a causal association” between the medication and compulsive behavior side effects, the FDA mandated these warnings to be placed on the drug’s label.
However, years earlier Canada and Europe both beat the U.S. in adding these warnings to the drug’s label.
According to Health Canada, a “current review concludes that there is a link between the use of aripiprazole and a possible risk of pathological gambling or hypersexuality. “After the totality of evidence was considered, and because of the extensive use of Abilify, Health Canada has updated the Canadian prescribing information for Abilify…”
The Compulsive Behavior and Abilify Lawsuit is Case No. 3:18-cv-00320-MCR-GRJ, in the U.S. District Court for the Northern District of Florida, Pensacola Division. The Abilify MDL is In re: Abilify (Aripiprazole) Products Liability Litigation, MDL No. 3:16-md-2734, in the U.S. District Court for the Northern District of Florida.
In general, Rexulti and Abilify lawsuits are filed individually by each plaintiff and are not class actions.
