Complete MoisturePlus Contact Solution Class Action Settlement

Complete MoisturePlusRemember the eye infection scare in 2007 that had people throwing away their bottles of Complete MoisturePlus contact solution because they possibly contained a parasite? Well, a class action lawsuit settlement against the manufacturer has just been reached that will provide 100% cash refunds or coupons to California consumers who purchased Complete MoisturePlus contact solution from June 8, 2003 to the present.

The Complete MoisturePlus settlement will resolve a 2007 class action lawsuit, entitled Lazar vs. Advanced Medical Optics, that charged the company with consumer fraud for misrepresenting the safety of its contact solution.

In May 2007, Advanced Medical Optics (now Abbott Medical Optics, “AMO”) recalled Complete MoisturePlus after a report issued by the CDC noted an increased risk of developing a parasitic eye infection called Acanthamoeba keratitis in contact lens wearers who used the product.

The AMO class action lawsuit alleged that AMO misled consumers into falsely believing that the product would effectively “disinfect” their contact lenses when in fact the solution did not disinfect against Acanthamoeba and other harmful organisms that are known to contaminate contact lenses. AMO denies the allegations and claims that Complete MoisturePlus met all FDA requirements, but has agreed to a class action settlement to resolve the litigation.

Under the AMO contact solution class action settlement:

— AMO will give a 100% cash refund for every bottle of Complete MoisturePlus that a California consumer bought since June 8, 2003, if the consumer can document the purchase through a receipt or a bottle;

— If a consumer cannot document his purchase of the product through a receipt or a bottle but attests to the purchase, AMO will give the consumer a $10 coupon that is “as good as cash” toward the purchase of certain other AMO products;

— AMO will pay the difference between the total of the cash refunds paid and $650,000 to Guide Dogs of America and Children’s Vision First;

— AMO will no longer sell Complete MoisturePlus in California;

— If AMO applies to the FDA during the next three years for clearance to market a multi-purpose disinfecting solution that employs a “no-rub” and “no-rinse” regimen, AMO will request the FDA’s permission to include on the product label specific cautionary language concerning the disinfecting ability of the solution.

To receive the 100% cash refund or the “good as cash” coupon from the AMO Complete MoisturePlus settlement, you must submit a claim form either online at www.AMOSettlement.com or postmarked no later than February 16, 2012.

    What if I used this product and experienced severe eye problems and have my troubles documented in doctor visits and I am just now finding out about this? It looks like I am too late to qualify for anything. Granted, I wouldn’t want a ‘coupon’ for the suffering I endured…
