A Pennsylvania federal judge has granted preliminary approval to a $117.5 million class action settlement resolving claims Comcast failed to protect its customers’ sensitive information during an October 2023 cybersecurity attack.
U.S. District Judge John Milton Younge said in his Jan. 16 order that the agreement is preliminarily approved “as fair, reasonable, and adequate” and scheduled a final approval hearing for July 7.
The Comcast settlement will benefit 31.6 million customers who were sent individual notifications of the October 2023 Comcast data breach, which was publicly disclosed in December 2023, according to the court filing.
Under the terms of the Comcast class action settlement, class members can receive three years of free financial and credit monitoring and identity theft protection, plus either a reimbursement of out-of-pocket losses and lost time of up to $10,000 or an alternative cash payment of $50.
Comcast data breach affected more than 31 million customers
Plaintiff Kenneth Hasson filed his complaint arising from the Comcast data breach in Pennsylvania federal court in December 2023. In March 2024, Hasson’s request to consolidate 24 related cases then pending in the Eastern District of Pennsylvania was granted.
The class action settlement also resolves claims against other defendants in the litigation, including Citrix Systems Inc. and Cloud Software Group Inc., according to the motion for preliminary approval.
According to the Comcast class action lawsuit, Comcast contracted with Citrix to provide networking hardware and software services, including its Netscaler products, which allow customers like Comcast to consolidate remote access infrastructure and provide a single sign-on across all applications.
Between Oct. 16 and Oct. 19, 2023, unauthorized third parties gained access to Comcast’s internal systems and acquired usernames and passwords, names, contact information, last four digits of Social Security numbers, dates of birth and/or secret questions and answers for over 30 million former and current Comcast customers, according to the motion.
Comcast said in a statement: “Though we disagree with the claims, this settlement reflects our commitment to resolving this matter efficiently while continuing to prioritize the security and privacy of our customers.”
In related news, a new class action alleges that Comcast, through its Xfinity TV and internet service provider, violated the Telephone Consumer Protection Act (TCPA) by placing pre-recorded debt collection calls to consumers throughout the U.S.
