Food and beverage company Mondelez International Inc. falsely advertises that its Clif Kid ZBar and ZBar Protein products are “climate neutral,” a new class action lawsuit alleges.
Plaintiff Cynthia Salguero claims Mondelez’s “climate neutral” claims are untrue and deceptive because the manufacturing, marketing and transportation of the products contribute to climate change and degradation.
“Defendant’s manufacturing and transportation of the Product causes carbon dioxide (“CO2”) and other greenhouse gases to be released in the atmosphere, contributing to climate change and harming the environment,” the Clif Kid ZBar class action says.
Salguero wants to represent a nationwide class and California subclass of consumers who purchased the Clif Kid products during the statute of limitations period.
Clif Kid class action claims Mondelez’s ‘climate neutral’ claim is misleading
Salguero argues producing the Clif Kid products result in the emission of roughly 54,000 tons of carbon dioxide equivalent annually, which she claims is equivalent to the annual emissions of 12,596 gasoline-powered automobiles.
“Therefore, Defendant’s climate neutral claim is false and misleading because the Product’s manufacturing and distribution results in substantial carbon emissions, other greenhouse gas emissions, and harm to the climate,” the Clif Kid ZBar class action says.
The class action lawsuit further argues consumers would not have purchased the Clif Kid products, or would have paid substantially less for them, had they known that the “climate neutral” claim was not true.
Salguero claims Mondelez is guilty of breach of express warranty and unjust enrichment, and violating California’s Unfair Competition Law and Consumers Legal Remedies Act.
The plaintiff demands a jury trial and requests declaratory and injunctive relief and an award of compensatory, statutory and punitive damages for herself and all class members.
Clif Bar & Co., which was acquired by Mondelez in 2022, previously agreed to pay $12 million to end claims the company’s Clif Bar packaging contained misleading claims to make the products seem healthy.
