Class Action Settlement Pays to Replace Cracked Windshields in Scion xBs

If you’ve ever owned or leased a 2006 Scion xB, you may be able to claim money or a free repair from a proposed class action settlement.

If approved, the class action settlement will settle allegations that the windshields of 2006 model-year Toyota Scion xBs have one or more defects that make their windshields prone to cracking and that these windshields were improperly excluded under warranty coverage. According to the class action settlement notice, class members have six years or 60,000 miles from the date of the original retail sale or lease of the vehicle (whichever occurs first) to claim one of the following benefits from the class action settlement:

(1) Reimbursement — If you paid to repair or replace a cracked Genuine Toyota windshield before the effective date of the settlement, you will be reimbursed for one such repair or replacement.

(2) Extended Warranty — If you need to replace or repair a cracked Genuine Toyota windshield after the effective date of the settlement, Toyota will replace the windshield one time at no cost to you through an authorized Toyota dealer, provided you have not already sought reimbursement under this settlement.

Windshields covered under this settlement will only be covered if they haven’t been cracked by something that would normally cause a windshield to crack (e.g., a collision, natural disaster, vandalism, etc.). The effective date of the settlement is expected to be August 24, 2010 but may change, depending on the courts. Claim forms must be postmarked no later than September 23, 2010, which is also subject to change.
