True Classic Tees class action lawsuit overview:

A new nationwide class action lawsuit accuses True Classic Tees of falsely advertising free shipping on its website while charging a hidden fee.

Plaintiff Stephen Edlund’s class action lawsuit alleges True Classic Tees adds a so-called “Package Protection & Sustainability Fee” to every online order placed on its website, despite claiming that it offers free shipping on purchases over $79.

Edlund argues the fee is deceptive and that True Classic Tees’ promise of free or low-cost shipping is false.

He wants to represent a nationwide class of consumers who paid True Classic Tees a Package Protection & Sustainability Fee within the applicable statute of limitations.

True Classic Tees’ fee is a ‘classic bait & switch,’ class action claims

Edlund claims consumers are not asked to consent to True Classic Tees’ terms of use and service and that the company prominently advertises free shipping or low-cost shipping on its website.

Despite this, Edlund argues True Classic Tees adds a fee to a consumer’s order once they click to check out.

“What’s worse, the optional hyperlink to ‘remove’ the ‘Package Protection & Sustainability Fee’ is so tiny, and intentionally designed to go unnoticed by consumers,” the True Classic Tees class action says.

Edlund claims consumers are left entirely unaware that the fee is optional and instead believe they have no choice but to pay it, calling the practice a “classic bait & switch.”

Edlund claims True Classic Tees is guilty of unjust enrichment and violating California’s Unfair Competition Law and Consumer Legal Remedies Act, among other things.

The plaintiff demands a jury trial and requests declaratory and injunctive relief and an award of statutory, monetary and punitive damages for himself and all class members.

In a pair of similar cases, a Williams-Sonoma lawsuit accused the retailer of allegedly advertising a fake free shipping fee, while a Costco class action alleges misrepresentation of delivery fees on its website.

The plaintiff is represented by Sophia Goren Gold and Jeffrey D. Kaliel of Kaliel Gold PLLC.
