A new class action lawsuit alleges GoMacro falsely advertises its snack bars as healthy when they actually contain unhealthy levels of added sugar.
Plaintiff Leah Testone claims GoMacro misleadingly markets its products, which include protein, snack and kids bars, as healthy food choices when they actually contain unhealthy levels of added sugar.
“GoMacro employs a strategic marketing campaign designed to convince consumers its products are healthier than they actually are,” the GoMacro class action states.
The plaintiff argues GoMacro’s products contain between 4 grams and 13 grams of added sugar, which she argues is “likely to increase the risk of cardiovascular disease, type 2 diabetes, metabolic disease and liver disease.”
Testone wants to represent a nationwide class and California subclass of consumers who purchased GoMacro bars within the applicable statute of limitations.
GoMacro’s marketing, advertising ‘false and misleading,’ class action alleges
Testone claims GoMacro is aware consumers are willing to pay more for foods they perceive to be healthy and thus employs a marketing campaign designed to convince consumers its products are healthier than they actually are.
“GoMacro’s health and wellness representations concerning the products are false and misleading,” the GoMacro class action states.
Testone claims GoMacro is guilty of negligent and intentional misrepresentation, unjust enrichment, breach of express and implied warranties and violating California’s consumer fraud laws.
The plaintiff demands a jury trial and requests declaratory and injunctive relief and an award of compensatory and punitive damages for herself and all class members.
Nature’s Bakery recently faced a similar class action lawsuit over allegations that the company misled consumers into believing its fig bars are healthy despite containing excessive amounts of added sugar.
