PlayStation 5 ‘Drifting’ Controller Class Action Takes Aim at Sony

A recent class action lawsuit alleges controllers for the PlayStation 5 are defective and “drift” without prompting during gameplay.

The plaintiff claims the console’s manufacturer is knowingly selling systems that have defective controllers. He says his PS5 controller wasn’t even working correctly the day he bought it and he has tried “every possible fix.”

The class action lawsuit claims Sony makes it impossible for the owners of PS5 consoles to get their controllers fixed or replaced because of customer service backlogs and demand for payment.

The plaintiff accuses Sony of breach of warranty and seeks to represent a nationwide Class of consumers.

AmeriGas Propane Tanks $6.5M Class Action Settlement

AmeriGas has agreed to a $6.5 million settlement resolving allegations that the company reduced the amount of propane in its pre-filled tanks while maintaining the same price.

The class action lawsuit alleged AmeriGas and Blue Rhino colluded in 2008 to lower the amount of propane in their pre-filled tanks without also reducing the price, thereby inflating prices for consumers.

The settlement agreement established two Classes: 

  • Indirect Purchaser Settlement Class: consumers from 13 states who bought or exchanged one or more AmeriGas and/or Blue Rhino pre-filled propane tanks or paid to exchange a tank between Dec. 1, 2009, and Nov. 30, 2020. 
  • Direct Purchase Settlement Class: a nationwide Class made up of consumers who purchased a propane tank directly from AmeriGas or Blue Rhino via a vending machine at retailers or other locations.

Class Members are eligible to claim up to $125 — $2.50 per tank for up to 50 tanks — with no proof of purchase required.

Class Members submitting proof of purchase can claim an unlimited number of tanks for $5 per tank.

The deadline to file a claim in the AmeriGas class action settlement is March 8, 2021.

Nissan Rogue CVT Class Action Launched over Jerking and Lurching

Certain model years of Nissan Rogue have a continuously variable transmission (CTV) that causes the popular crossover to shake and shudder, according to a recent class action lawsuit. 

Plaintiffs say the defect causes a shaky ride and the cost to fix the issue is exorbitant.

They also claim Nissan is aware of the issue but has not addressed it.

The excessive shuddering and jerking occurs at highway speeds, sometimes without warning, which can lead to safety hazards, the class action lawsuit argues.

The plaintiffs also maintain Nissan issued a number of technical service bulletins to dealerships about the alleged CVT defect but chose to conceal it from consumers.

The plaintiffs seek to represent a nationwide Class of 2014-through-2016 model year Nissan Rogue CVT owners and lessees.

Apple Hit With 25-State Gambling Apps Class Action

Apple allegedly hosts and profits from gambling-style apps that break laws in 25 states, a recent class action lawsuit claims.

The plaintiff claims Apple-hosted games developed by Zynga, such as Zynga Poker and Diamond Casino Slots, violate anti-gambling laws because of their “pay to get more time” function.

The plaintiff in the class action lawsuit says they paid more than $250 in coin purchases to Apple while playing Wizard of Oz slots.

Not only this, the class action lawsuit says, Apple also provided marketing guidance, contributed to the apps’ development, and makes significant commissions on in-app purchases in these apps.

The plaintiff seeks to represent a Class of consumers in 25 states who have paid money to Apple for coins to use on Zynga casino apps.

 Judge Denies DirecTV’s Move to Arbitrate TCPA Class Action

DirecTV is not allowed to use arbitration to settle claims it spans customers with unwanted marketing calls, a judge has ruled.

The judge called the company’s efforts to settle out of court “unconscionable” and “absurd.”

The lead plaintiff took on DirecTV in 2017 over claims the company violated the Telephone Consumer Protection Act (TCPA) by placing unwanted marketing calls despite the plaintiff’s number being listed on the Do Not Call Registry.
