A class action lawsuit alleges CBI Distributing Corp., doing business as www.icing.com, falsely advertises that its jewelry is available at a discounted price on its website.
Plaintiff Judy Oh claims Icing advertises fictitious regular prices and corresponding phantom discounts on products sold through its website.
“This practice allows Defendant to fabricate a fake ‘reference price’ and present the actual price as ‘discounted’ when it is not,” the Icing jewelry class action lawsuit says.
Oh wants to represent a class of all consumers who purchased one or more products from Icing’s website while in California within the statute of limitations period at a purported discount from a higher reference price.
Oh argues Icing’s alleged false advertising violates California’s False Advertising Law and Consumers Legal Remedies Act.
Icing uses deceptive pricing scheme, class action argues
Oh claims she purchased a silver-tone floral rhinestone choker necklace from Icing.com in January 2025 for a “discounted” price of $10, which the company allegedly compared to a “strike-through” reference price of $16.99.
“The reference price described in the preceding paragraph was not the ‘prevailing market price’ in the 90 days preceding the above access date,” the Icing class action lawsuit says.
Oh claims Icing knows that the prices for its products on the website are artificially inflated, and that it intentionally uses them in its deceptive pricing scheme to “increase sales and profits by misleading consumers to believe that they are buying products at a substantial discount.”
The plaintiff demands a jury trial and requests declaratory and injunctive relief and an award of statutory damages and attorneys’ fees and costs.
In related news, consumers filed class action lawsuits against Lowe’s Home Centers, L.L. Bean, Under Armour and Sleep Number Corp., alleging the companies advertised false discounts to mislead shoppers into thinking they were getting better deals than they actually were.
