Class Action Lawsuit Filed Over 2010 Kroger Pet Food Recall

In December 2010, Kroger recalled more than 68,300 bags from 10 brands of cat and dog food due to possible contamination of aflatoxin, a by-product from the growth of fungus on corn and other crops. Aflatoxin is known to cause sluggishness along with a reluctance to eat, yellowish tint to the eyes and/or gums, and/or diarrhea.
The lead Plaintiffs in the Kroger pet food recall class action lawsuit claim they fed their dog Kroger’s Old Yeller Chunk dog food before the dog became sick in January 2011 with symptoms of lethargy and vomiting. After two veterinary visits, the Plaintiffs’ dog died.
The recalled pet food was distributed to 19 states and sold at Kroger, Dillons and Gerbes grocery stores. In addition to Old Yeller Chunk Dog Food, the Kroger recall also covered the brands Pet Pride Tasty Blend Poultry & Seafood Cat Food, Pet Pride Kitten Formula, Kroger Value Cat Food, and Kroger Value Chunk Dog Food with a “sell by date” of October 23, 2011 and October 24, 2011. The Kroger pet food recall class action lawsuit is the first known case this year to involve aflatoxin contamination.

I had my male pitbull mastiff mix by on December 8th of 2009 and it was like 2 weeks later that I got the recall notice on the dog food that I’ve been feeding him here is my baby and I wish there was some way I could help make them pay for what they did to him
We have 2 1/2 Maltese / 1/2 Shiatsu (toy about 5 lbs each) My girls about 6 months old when we purchased Milo’s @ Cub Foods. Sophie wouldn’t touch it, Chloe seemed to love Milo’s. Day 3 Chloe could barely get out of her kennel and obviously was under much distress. She didn’t eat or drink the entire day. Following day she was so weak she could barley stand and got severe diarrhea. I took her in to vet, ran a battery of tests (revealed nothing). After much fluids, 2 weeks of special diet she regained. I ALWAYS BELIEVED IT WAS MILO’S – as Sophie NEVER became ill. This was the ONLY difference. Cost me $300 and I can’t put a dollar value on my worry & frustration.
