Parents are tricked into buying more expensive Enfamil LIPIL baby formula over cheaper brands, claims a recent class action lawsuit.
According to the class action complaint, Mead Johnson & Co., the maker of Enfamil LIPIL, falsely claims the baby formula is the only one on the market that contains DHA and ARA, products “clinically proven to improve brain and eye function in infants.” The class action complaint goes on to accuse Mead Johnson of making this false claim as part of a “smear campaign” against its competitors because it’s facing “significant competition from lower-priced brands.” These lower-priced competitors, including store brands, make baby formula containing DHA and ARA “in amounts equal to or greater than those contained in” Enfamil and are “no less effective.”
Enfamil’s slogan “Store brands may cost less, but Enfamil gives your baby more” is deceptive, according to the class action lawsuit, and has duped class members into paying more for Enfamil because they “mistakenly believed they were purchasing the only infant formula that provides the blend of nutrients essential to the brain and eye development of their babies.” If approved, the class action lawsuit will seek an injunction barring Mead Johnson from making these false claims and damages for class members.
