
Walmart FCRA class action lawsuit overview:

A new class action lawsuit claims Walmart violated the Fair Credit Reporting Act by failing to provide a copy of a consumer report to a prospective employee before taking adverse action.
Plaintiff Cynthia Hollingsworth claims Walmart obtained a consumer report from a consumer reporting agency and relied on it to make a decision to withdraw a job offer without first providing her with a copy of the report.
Hollingsworth wants to represent a class of Walmart applicants who were the subject of a consumer report used by Walmart for employment purposes within the past five years and suffered an adverse employment action by the company. Additionally, applicants were not provided a copy of the report and/or a written summary of their rights under the FCRA before the adverse action notice.
Walmart allegedly failed to provide job applicant with time to review consumer report
Hollingsworth claims Walmart violated the FCRA by failing to provide her with a copy of her consumer report before taking adverse action, failing to provide her with a reasonable time to address the information in her report and failing to provide her with a reasonable time to dispute her report.
The plaintiff argues Walmart should have given her time to review, explain, dispute and/or otherwise address the information contained in the consumer report.
Hollingsworth claims she would never have permitted Walmart to obtain a copy of her consumer report if she had known the company employed a policy to take adverse action in violation of the FCRA.
The plaintiff demands a jury trial and requests declaratory and injunctive relief and an award of statutory damages of not less than $100 and not more than $1,000 for each violation, plus punitive damages and attorneys’ fees and costs.
Meanwhile, Walmart agreed to pay $10 million to settle Federal Trade Commission charges that it allowed scammers to exploit its in-store money transfer services to take hundreds of millions of dollars from U.S. consumers.
