A new class action lawsuit claims Tesla violates California state law by collecting users’ data without their consent on its website.

Plaintiff Peter Dawidzik alleges Tesla’s website contains third-party trackers that collect users’ data without their consent.

Dawidzik argues the third-party trackers collect data from users of Tesla’s website for the purpose of behavioral profiling, ad targeting and cross-device tracking, among other things.

“Plaintiff and the class members did not consent to the installation, execution, embedding or injection of the trackers on their devices and did not expect their behavioral data to be disclosed or monetized in this way,” the Tesla class action says.

Dawidzik wants to represent a California class of individuals who accessed Tesla’s website during the relevant statute of limitations period.

Class action: Tesla website trackers violate California privacy law

Dawidzik claims Tesla is guilty of violating the California Invasion of Privacy Act and the state’s Unfair Competition Law.

The plaintiff demands a jury trial and requests declaratory and injunctive relief and an award of statutory damages, pre-judgment interest and attorneys’ fees and costs.

A Tesla owner filed a separate class action lawsuit against the company in April alleging it failed to disclose to consumers that its vehicles’ cameras are constantly recording and that the footage is accessible to Tesla employees.

Earlier this year, the National Highway Traffic Safety Administration opened an investigation into Tesla vehicles over features that let users remotely move their cars with a phone app, following reports of collisions with posts and parked cars.
