A new class action lawsuit accuses Flagstone Foods of falsely advertising its Emerald Nuts products as being free from artificial preservatives.
Plaintiff Derrick Young filed the class action complaint against Flagstone Foods on April 24 in California federal court, alleging violations of state and federal consumer laws.
The lawsuit alleges that Flagstone Foods’ Emerald Nuts products contain artificial preservatives despite being advertised as containing “No Artificial Flavors, Preservatives or Synthetic Colors.”
Young claims that the products contain manufactured citric acid, an artificial preservative, which contradicts the product’s labeling.
“Defendant’s packaging, labeling and advertising scheme is intended to give consumers the impression that they are buying a premium product that contains no artificial preservatives,” the Emerald Nuts class action says.
Young argues he was deceived by Flagstone Foods’ alleged false advertising and is seeking to represent a California class of consumers who purchased the products.
The lawsuit claims that Flagstone Foods’ actions violate California’s Consumers Legal Remedies Act, Unfair Competition Law and breach of express warranty.
Consumers were misled by false advertising, Emerald Nuts class action alleges
Young argues that consumers rely on product labels to make informed purchasing decisions, and that the alleged false advertising led them to believe they were buying a healthier product.
“Consumers, including Plaintiff, would not have purchased Defendant’s Products, or would have paid less for the Products, if they had known the Products actually contain an artificial preservative ingredient,” the Emerald Nuts class action says.
The lawsuit seeks damages and restitution for consumers who purchased the products as well as injunctive relief to prevent Flagstone Foods from continuing to advertise the products as free from artificial preservatives.
Continental Mills recently faced a similar class action lawsuit alleging it falsely advertises its Krusteaz Cinnamon Swirl Crumb Cake & Muffin Mix as containing no artificial preservatives.
A pair of class action lawsuits also accuse Target of falsely advertising its Good & Gather pasta sauces as free from artificial preservatives when the products in fact contain synthetic citric acid.
