A new Hawaiian Tropic class action lawsuit claims the company falsely advertises its Everyday Active SPF 50 Sport Sunscreen Lotion.
Plaintiffs Agatha Lewandowska Giannese and Andrea Fahey filed the class action complaint against Edgewell Personal Care Brands on Oct. 10 in Connecticut federal court, alleging violations of state and federal consumer laws.
The pair allege in the lawsuit that Edgewell falsely advertises its Hawaiian Tropic Everyday Active SPF 50 Sport Sunscreen Lotion as providing SPF 50 protection when it actually provides only SPF 20 protection.
They claim the sunscreen’s labeling and advertisements mislead consumers into believing they are purchasing a product with higher sun protection than it actually offers.
The complaint claims independent laboratory testing commissioned by the plaintiffs’ counsel revealed the product’s true SPF level to be 20, less than half of the advertised SPF 50.
The plaintiffs argue that consumers are willing to pay a premium for high-SPF sunscreens, believing they offer better protection against sunburns and other harmful effects of ultraviolet radiation.
They allege Edgewell capitalized on this consumer demand by falsely labeling the product, allowing it to be sold at higher prices and generating more revenue and profit for the company.
Hawaiian Tropic class action alleges sunscreen misrepresented
The plaintiffs claim they and other consumers were induced to purchase the sunscreen based on its false SPF claims, either paying more for the product than they would have if it had been accurately labeled or buying a product they otherwise would not have purchased.
The lawsuit alleges Edgewell’s misrepresentations have caused significant harm to consumers nationwide, leading them to pay a premium for a product that does not deliver the promised level of sun protection.
The plaintiffs are seeking actual damages, restitution, injunctive relief and other legal and equitable remedies on behalf of themselves and other consumers who purchased the sunscreen.
They are looking to represent anyone in the United States who purchased the sunscreen during the applicable limitations period.
Earlier, two consumers filed a class action lawsuit against Edgewell, accusing the company of failing to disclose that its Billie All Day Deodorant can cause chemical burns and skin irritation.
