The Clorox Co. and Hamilton Beach Brands falsely marketed their air purifiers as being equipped with HEPA filters, according to a new class action lawsuit.
Plaintiff Roberta D’Alois claims Clorox and Hamilton Beach falsely advertised their air purifiers as being equipped with HEPA filters when they actually were not.
D’Alois argues Clorox and Hamilton Beach continued to sell their air purifiers and replacement filters with false HEPA claims after the companies allegedly learned their products did not meet HEPA standards.
“Defendants knew this but continued hocking their wares, making a killing selling the air purifier and replacement filters since the outset of the COVID-19 pandemic,” the air purifier class action lawsuit says.
D’Alois wants to represent a nationwide class and California subclass of consumers who purchased a Clorox air purifier or replacement filter during the applicable statutory period.
Lawsuit: Clorox, Hamilton Beach profited off false HEPA claims
D’Alois claims Clorox and Hamilton Beach violated California’s Unfair Competition Law, False Advertising Law and Consumers Legal Remedies Act and are guilty of fraud, unjust enrichment and breach of express warranty.
D’Alois argues Clorox and Hamilton Beach profited greatly from the false HEPA claims and that the fair value of their air purifiers would have been substantially lower if the companies had been truthful about their filtration capabilities.
“Plaintiff now seeks a return of the HEPA-related premiums that defendants charged for their products, on behalf of the plaintiff and other similarly situated purchasers,” the class action lawsuit says.
D’Alois demands a jury trial and requests declaratory and injunctive relief and an award of compensatory and statutory damages for herself and all class members.
Earlier, a consumer filed a class action lawsuit against Honeywell International Inc., alleging it falsely advertised its air purifiers as containing HEPA filters.

We had a horrible mold problem, but I didn’t figure it out because I trusted the HEPA air purifiers and filters that I had purchased. My child missed sooo much school due to chronic mold exposure.

The whole reason I bought Clorox air purifier is it said Hepa. These filters are not cheap, so I hope to gain at least half my money back

Yes, I have bought at least 5 just this year . But in 2024, 2023,2022, and I will have to check to be certain but I have bought several each previous year so each year I had a new Clorox air purifier.

I have been buying these expensive filters for years now and it’s doing nothing? Let alone how much it was in the first place. Whole reason I bought it was due to the name brand and saying it was hepa.
