A new class action lawsuit claims True Religion falsely advertises sales on its website.

Plaintiff Nichoma Neil filed the class action complaint against True Religion Apparel and True Religion Sales on Nov. 13 in California federal court, alleging violations of state and federal false advertising laws.

Neil claims True Religion has been engaging in deceptive advertising practices by consistently promoting fake sales and discounts on its website.

The plaintiff alleges the company advertises items at steep discounts from purported regular prices, creating a false sense of urgency for consumers to make purchases.

According to the complaint, True Religion’s website displays banners and advertisements boasting limited-time sales, offering significant percentages off regular prices. However, Neil alleges the discounts are almost always available, rendering the sales promotions misleading and unlawful.

Class action: True Religion’s website does not reflect products’ actual market value

The lawsuit further alleges that the regular prices listed on True Religion’s website do not reflect the actual market value of the products. Neil says an investigation revealed that the advertised regular prices were not the prevailing prices for the items in the three months preceding the promotions, a violation of California’s False Advertising Law.

The complaint cites multiple examples of True Religion’s alleged deceptive practices, including screenshots from the company’s website showing ongoing sales promotions with claims of limited-time offers. Neil argues that these tactics mislead consumers into believing they are getting a better deal than they actually are.

As a result, Neil is looking to represent anyone who purchased True Religion products advertised at a discount on the company’s website within the applicable statute of limitations period.

She is suing for violations of California’s False Advertising Law, Consumers Legal Remedies Act and Unfair Competition Law, breach of contract, breach of express warranty, quasi-contract/unjust enrichment, negligent misrepresentation and intentional misrepresentation and seeks certification of the class action, damages, fees, costs and a jury trial.

Earlier this year, True Religion faced a similar class action lawsuit claiming it sent false and misleading emails to consumers to entice them into making purchases.
