A new class action lawsuit alleges New Cibo Vita LLC falsely advertises that its Nature’s Garden Probiotic Strawberry Yoggies and Nature’s Garden Probiotic Mixed Berry Yoggies contain 2 billion probiotics per serving.
Plaintiff Michelle Move argues in the Nature’s Garden class action lawsuit that New Cibo Vita makes the claim on the product’s packaging and in its advertising despite the fact that the snacks do not contain anywhere near that amount of probiotics.
Move claims she hired an independent laboratory to test the snacks and that the results showed they contained no probiotics at all.
Move wants to represent a nationwide class of consumers who purchased Nature’s Garden Probiotic Yoggies. She is suing for violations of New Jersey’s Consumer Fraud Act, breach of express and implied warranties and unjust enrichment and is demanding a jury trial and requesting declaratory and injunctive relief and an award of compensatory and punitive damages for herself and all class members.
Nature’s Garden falsely claims snacks contain no artificial ingredients, lawsuit alleges
Move claims New Cibo Vita also falsely claims its Nature’s Garden Probiotic Yoggies contain no artificial ingredients.
The plaintiff argues the snacks contain microencapsulated probiotic Lactobacillus Rhamnosus GG, which she claims is synthetically developed and does not exist in nature.
Move argues the alleged misrepresentations about the probiotics and artificial ingredients in the snacks are material to consumers’ purchasing decisions and that New Cibo Vita has unjustly profited from the false advertising.
The plaintiff demands New Cibo Vita be ordered to reformulate its Nature’s Garden Probiotic Yoggies to contain the advertised amount of probiotics and to remove the artificial ingredients.
In May 2024, Poppi’s maker, VNGR Beverage LLC, faced a class action lawsuit alleging that its “Poppi Prebiotic Sodas” were misleadingly marketed as “gut healthy” despite containing only two grams of prebiotic fiber and high sugar levels.
