A new class action lawsuit alleges Skechers USA tracks consumers’ online activity without their consent.

Plaintiff Shahd Erakat filed the class action complaint against Skechers USA on Nov. 20 in California federal court, alleging violations of state privacy laws.

According to the class action lawsuit, Skechers USA’s website, www.skechers.com, uses tracking software that monitors users’ online activity without their consent.

Erakat claims the tracking software captures users’ IP addresses, session data and clickstream activity in real-time, violating the California Invasion of Privacy Act (CIPA).

“Defendant surreptitiously installs and operates tracking software on the Website without providing users with adequate notice or obtaining their informed consent,” the class action lawsuit alleges.

Skechers USA allegedly uses the tracking software for identity resolution, targeted advertising and monetization of consumer data. 

The lawsuit claims the company enables third-party technologies to capture detailed information about users’ electronic communications without judicial authorization.

Skechers USA class action alleges data illegally monetized

The lawsuit alleges that Skechers USA’s website uses tracking technologies from companies like Google, Taboola and The Trade Desk to collect user information for advertising purposes.

These technologies allegedly function as unlawful pen registers and/or trap and trace devices, capturing users’ routing and addressing information without their knowledge or consent.

“Defendant aids, employs, agrees and conspires with these Third Parties by embedding and activating their tracking technologies within the Website,” the class action lawsuit alleges.

Erakat claims the tracking software allows Skechers USA and its third-party partners to fingerprint and profile users, synchronizing their identities across multiple sites and participating in real-time bidding and targeted advertising exchanges. 

The lawsuit alleges that this data collection enables the company to monetize visitors’ personal information and browsing activity.

Erakat seeks to represent all California residents who have accessed and used skechers.com. She is suing for violations of California privacy laws and seeks certification of the class action, damages and injunctive relief.

In September, Skechers was sued by a consumer who claimed the company deceived customers by promoting its shoes as providing health and fitness benefits not supported by evidence.
