Chosen Foods class action lawsuit overview:

Chosen Foods LLC falsely advertises that its avocado oil is non-genetically modified, a new class action lawsuit alleges.

Plaintiff Summer Whiteside’s nationwide class action lawsuit claims Chosen Foods prominently displays a non-GMO label on its avocado oil products, despite there not actually being any genetically modified avocado oil on the market.

“Defendant’s Non-GMO Claims are misleading because all avocado oil products are non-GMO—no GMO version of avocado oil is present on the market today,” the Chosen Foods class action says. 

Whiteside further argues that consumers are willing to pay more for non-GMO products, which she claims Chosen Foods took advantage of by misleading consumers into believing its avocado oil has a trait that other competing avocado oils do not have.

Whiteside wants to represent a nationwide class of consumers who purchased Chosen Foods avocado oil for personal use. 

Chosen Foods greenwashes avocado oil products, class action claims

Whiteside argues Chosen Foods uses the non-GMO label as a “marketing ploy” to greenwash its avocado oil products and gain an unfair advantage over its competitors.

“Defendant’s advertising scheme is intended to give consumers the impression that they are buying a premium product that is non-GMO, when in fact the Non-GMO Claims do not distinguish the Products in any way from other avocado oil products that do not have Non-GMO Claims,” the Chosen avocado oil class action says.

Whiteside claims Chosen Foods is guilty of violating California’s Unfair Competition Law and Consumers Legal Remedies Act.

The plaintiff demands a jury trial and requests declaratory and injunctive relief and an award of restitution and disgorgement of all profits and unjust enrichment for herself and all class members.

Consumers filed similar class action lawsuits last year against Walmart and Target for selling “pure avocado oil” at a premium that was allegedly diluted with other oils, affecting the Great Value and Good & Gather brand avocado oils respectively.
