Woman suffering from brain tumor lying in hospital bedA woman has filed a Taxotere side effects lawsuit against Sanofi-Aventis after its alleged wrongful conduct related to its prescription medication.

Plaintiff Kelly S., an Illinois resident, was prescribed Taxotere as a chemotherapy treatment for her breast cancer. Kelly was diagnosed with stage II breast cancer in July 2015.

Kelly underwent three or four cycles of Taxotere chemotherapy during September 15 through approximately November 2015.

Following her treatment with Taxotere, Kelly claims that she suffered disfiguring permanent alopecia (hair loss) as a result of her Taxotere treatment, according to the Taxotere side effects lawsuit.

“There were already products on the market as least as effective as Taxotere that did not subject users to the same risk of permanent alopecia, but users of Taxotere were not presented with the opportunity to make an informed choice as to whether the benefits of Taxotere were worth the associated risk,” the Taxotere side effects lawsuit states.

“Defendants engaged in a pattern of deception by overstating the benefits of Taxotere as compared to other alternatives while simultaneously failing to warn of the risk of alopecia,” Kelly claimed in her lawsuit.

Kelly filed her lawsuit within two years of suspecting that Taxotere was responsible for her permanent hair loss.

In her Taxotere side effects lawsuit, Kelly states that in addition to her permanent hair loss, she has also endured pain and suffering, economic loss, medical expenses, psychological counseling and therapy expenses.

She also claims that she has endured past and future loss of earnings, mental anguish, severe emotional distress and loss of enjoyment of life and will continue to incur those losses in the future.

Kelly alleges in her lawsuit that Sanofi-Aventis failed to fully and accurately describe the safety profile of Taxotere and failed to provide adequate warnings about the true safety risks of Taxotere, especially those related to permanent alopecia.

Sanofi-Aventis allegedly also failed to list permanent hair loss as a side effect on the warning label, failed to advise physicians about permanent alopecia as a side effect and failed to provide information about how to reduce the risk of alopecia and more.

Kelly has brought forth claims of product liability for negligence, design and manufacturing defects, failure to warn, breach of express warranty, breach of implied warranty as well as fraudulent misrepresentation.

She also cites fraudulent concealment, negligent misrepresentation, strict product liability for misrepresentation, fraud and deceit and extreme and outrageous conduct/intentional infliction of emotional distress.

The plaintiff is seeking a judgment against Sanofi-Aventis in an amount to be determined at trial for her injuries and losses as well as special damages, trouble damages, attorneys’ fees and costs, pre-and post-judgment interest and any additional relief from the court that is deemed just and proper.
