Praxair Truck Driving Basics
Praxair truck drivers are used to delivering industrial gasses and chemicals to business clients across the country. These materials may be hazardous, and as such the drivers are required to stay with their trucks at all times. The safety concern here is legitimate, as potential exposure to such hazardous materials is serious. However, requiring truck drivers to stay with the trucks all the time, even on their rest periods and breaks, could mean that they are denied proper break times as required by law. Required Rest Periods and Breaks
Workers who have not been exempted are entitled to both rest periods and breaks, some of which should be paid.
Nonexempt workers are eligible to take rest periods of at least ten minutes. The number of rest breaks a worker can take varies by how many hours a shift lasts. For instance, a three and a half hour shift only requires one rest break, but a six hour shift adds in another 10 minute break. A third break is added for shifts 10 hours or more.
Meal breaks function similarly, though there are fewer of them per shift. A 30-minute meal break is required for a five-hour shift, with another added if the shift is 10 hours or more.
If a worker does not take rest periods and breaks, they are then entitled to monetary compensation for that time. But not taking breaks must be the worker’s choice—they cannot be required to work during rest periods and breaks, even to stay with a truck carrying hazardous material.
Wage and Hour Laws
There are a series of both federal and state wage and hour laws in place to protect workers like Praxair truck drivers and ensure they are treated fairly at Praxair jobs and elsewhere.
Some workers may not file wage and hour complaints over violations of these laws because they are not aware of the specifics of the Fair Labor Standards Act (FLSA) and state labor laws. Others may find themselves disinclined as they are afraid that their employers may retaliate or even fire them if they speak up.
