sarku-japanA California wage and hour class action lawsuit was filed after a Teriyaki and Sushi chain allegedly broke federal overtime laws.

Plaintiff Albin Nunez claims in the unpaid overtime class action lawsuit that Sarku Japan allegedly prevented employees from taking meal breaks and failed to properly pay them overtime wages that were due to them. 

Nunez filed the California overtime class action in Los Angeles against Sarku Japan alleging that the teriyaki and sushi restaurant violated California labor laws. Sarku allegedly failed to pay their employees for all of the hours that they worked and forced their employees to work off the clock. They were also not paid for work related expenditures.

Nunez used to work for the restaurant chain and seeks to represent all current and former employees of teriyaki and sushi chain who were not given the overtime pay they were due or had other financial losses caused by the company’s alleged overtime violations. This wage and hour class action lawsuit is for employees who worked for the defendant within the past four years.

Federal Overtime Law Violations

The wage and hour class action accused the restaurant chain of several violations. One was that their meal times did not meet California wage and hour laws. Employees must be given a 30 minute meal break after working a certain amount of hours.

Not only were class members denied meal periods, they were not compensated appropriately for the lost lunch break. If an employee misses a lunch or break period, then according to California overtime law, they must be paid over time or for an additional hour of work.

Overtime wages are one and one-half times the hourly rate. California employee laws state that an employee is paid the overtime rate of pay if they work for more than 8 hours a day and/or more than 40 hours a week.

There are exceptions to this rule, but many hourly employees are non-exempt employees that have been misclassified. Many California employers have been accused of failing to pay countless hours of overtime work.

Other allegations in the California wage and hour class action lawsuit include failure to pay minimum wages, failure to pay timely wages, failure to give accurately itemized wage statements, keep accurate records, and more.
