California wage and hour overtimeBrookdale Senior Living is facing a potential class action overtime pay lawsuit alleging the company was failing to properly compensate its employees for overtime.

This potential class action overtime pay lawsuit was filed by plaintiff Geneflor Sacro, a former registered nurse supervisor at Brookdale Camarillo in California. Sacro worked at the Camarillo Brookdale location from March 3, 2015 to June 2, 2016. During this time, the senior living community was called Emeritus at Camarillo.

During her time at Brookdale, Sacro and other non-exempt nurses were told to work overtime hours only on pre-approved situations. The potential overtime pay lawsuit states that Brookdale had maintained a “strict policy against unscheduled overtime” to reportedly avoid paying employees overtime hours.

However, due to the nurses’ “excessive workloads,” Sacro says she and other nurses were regularly made to work off-the-clock after they had clocked out after their eight hour shift. She claims that even after clocking out, the nurses would be reportedly forced to work with Sacro and other nurses often working between 10 to 14 hour shifts.

In addition, the potential class action overtime pay lawsuit stated the nurses were regularly denied meal periods.

Overview of California Overtime Policy

Under California labor laws, minimum wage requirements mandate that non exempt employees be paid an overtime rate of 1.5 times the hourly rate. Employees in California become eligible for overtime benefits if employees work for over eight hours in a single work day, or over 40 hours a week.

However, California overtime rules state that the employee’s rate must be double for hours worked if the employee works over 12 hours in a single workday and for all hours worked in excess of eight on the seventh consecutive day of a single workweek.

Furthermore, California labor laws also require employers to compensate employees for every missing meal period, rest period, and any off-the-clock work. Even though Sacro and other nurses were owed overtime pay, meal periods, and off-the-clock compensation, Brookdale would not pay these missed wages, Sacro alleges.

Sacro is seeking class action status for her overtime pay lawsuit, stating that there are over 200 potential class members from other California Brookdale properties.

Sacro’s overtime pay lawsuit is seeking compensation for all unpaid wages, and is seeking to discontinue Brookdale’s “unfair and unlawful business practices.”
