A new class action lawsuit alleges Bouqs sent consumers emails with false and misleading subject lines advertising discounts on its products.
Plaintiff Lindsay Zerfas filed the class action complaint against The Bouqs OpCo on Dec. 30 in Washington state court, alleging violations of the Washington Commercial Electronic Mail Act (CEMA) and the Washington Consumer Protection Act (CPA).
Zerfas claims Bouqs sent emails to Washington residents with subject lines advertising time-limited promotions or discounts on its products that were not actually true.
“For example, ‘LAST CHANCE: 25% OFF ENDS TONIGHT,’ ‘Final hours to upgrade your Bouq—on us’ and ‘FINAL HOURS for savings!’ But the sales do not really end when the emails say they will,” Zerfas says.
Zerfas argues the emails were materially deceptive and drove sales by creating a false sense of urgency to purchase before the sale ends and a false sense of value based on a misleading discount.
Bouqs class action claims company regularly extends sales
Zerfas claims Bouqs regularly extended its sales after the false deadline expired or replaced them with a similar or better sale within days.
“Bouqs puts in the misleading time limits, knowing that the sale will not really end when the email says or will quickly be replaced by a materially similar one, because these misleading time limits create a sense of urgency and drive sales,” the Bouqs class action lawsuit says.
Zerfas wants to represent a class of Washington residents who received promotional emails from Bouqs with subject lines advertising sales or discounts on its products.
She is demanding a jury trial and requesting declaratory and injunctive relief and an award of actual and statutory damages for herself and all class members.
Currently, sports apparel company Fabletics is also facing allegations it violated Washington’s CEMA by sending unsolicited emails with false or misleading subject lines that either misrepresented the length of the sale or disguised the email’s true commercial purpose.
