A new class action lawsuit alleges Bobo’s falsely advertises its strawberry- and grape-flavored PB&J oat bars as healthy and conducive to physical well-being despite the products containing large amounts of added sugar.
Plaintiffs Christina Hankins and Dimari Benavidez filed the class action complaint against Simply Delicious on July 9 in California federal court, alleging violations of state consumer laws.
Hankins and Benavidez argue that Bobo’s oat bars are misbranded and falsely advertised as healthy despite containing between 15 and 16 grams of added sugar per serving.
“Bobo’s employs a marketing strategy designed to give consumers the erroneous impression that they are healthy or are conducive to good health and physical activity and well-being,” the Bobo’s class action states.
Bobo’s packaging designed to give a false impression, class action claims
Hankins and Benavidez argue consumers conflate claims of naturalness with an assertion that a food is healthy, and that the combination of text, graphical elements and pictures on the Bobo’s oat bars’ packaging is designed to give consumers the impression that the products are healthy.
Hankins and Benavidez argue Bobo’s prominently makes claims on the oat bars’ label that they are made with “wholesome” and “simple” ingredients and are “nutrient dense.”
“Claims such as ‘simple ingredients,’ ‘plant-based,’ ‘vegan’ and ‘non-GMO’ are meant to convey an impression that the products are ‘natural,’” the Bobo’s class action says.
Hankins and Benavidez claim Simply Delicious is guilty of unjust enrichment and breach of implied warranty and of violating California’s Consumers Legal Remedies Act.
The plaintiffs demand a jury trial and request declaratory and injunctive relief and an award of compensatory and statutory damages for themselves and all class members.
In other class action targeting “healthy” claims, two California residents allege Nature’s Bakery misleads consumers into believing its fig bars are healthy despite containing excessive amounts of added sugar.
