A new class action lawsuit accuses Boba Guys of misleadingly marketing its drinks as free of artificial ingredients despite containing high levels of plastic chemicals.

Plaintiff James Totten filed the class action complaint against Boba Guys in California federal court, alleging violations of state and federal consumer laws.

Boba Guys is a popular boba tea company with stores across California and New York City. The drinks are marketed as “next level quality” and “free of artificial ingredients,” but Totten alleges they contain high levels of bisphenol A (BPA), a toxic plastic chemical.

BPA is an endocrine-disrupting chemical used to make plastics harder. It is known to be harmful to human health, with links to reproductive and developmental toxicity, cancer, hormonal disruption and infertility.

Lawsuit: Boba Guys drinks contain high levels of BPA

According to the class action lawsuit, recent third-party testing revealed that Boba Guys drinks contained, or risked containing, high levels of BPA. In one instance, a Boba Guys drink was found to have more than 32,000% above what the European Food Safety Authority deems safe for BPA consumption.

Totten claims the source of the contamination is the brown sugar used in Boba Guys drinks. Brown sugar is used in all of the company’s milk teas, making the BPA contamination widespread, he alleges.

Despite the high levels of BPA, Boba Guys did not warn consumers of the risk associated with consuming its products, Totten claims.

He says the company had a duty to warn consumers of the potential risk of consuming its products, but failed to do so.

Totten is looking to represent anyone in the United States who purchased Boba Guys milk tea products and all products that contain its brown sugar-based sweetener during the applicable statute of limitations period.

He is suing for violations of California’s Consumers Legal Remedies Act, Unfair Competition Law and False Advertising Law and unjust enrichment. He is seeking certification of the class action, damages, fees, costs and a jury trial.

Similarly, Chobani faced a class action lawsuit accusing the company of failing to disclose that its yogurt products contain phthalates, a type of toxic chemical.
