A new class action lawsuit claims Blue Ice vodka is falsely advertised as “handcrafted” and “fit-friendly.”
Plaintiffs Mario Sava and Alin Pop filed the Blue Ice class action lawsuit against 21st Century Spirits and a group of social media influencers in Illinois federal court, alleging violations of state and federal consumer laws.
Their lawsuit alleges Blue Ice vodka’s advertising is misleading and causes consumers to pay a premium for the product that is undeserved.
The plaintiffs argue that both the vodka company and a group of social media influencers are responsible for misleading advertising claims.
The lawsuit alleges that 21st Century Spirits, the maker of Blue Ice vodka, and a group of social media influencers, including Leanna Bartlett, Alexa Collins and Sarah Houchens, have engaged in deceptive advertising practices.
The plaintiffs claim that the influencers promoted the vodka as “handcrafted” and “fit-friendly” without disclosing that they were paid to do so.
Blue Ice vodka falsely advertised as ‘handcrafted,’ ‘fit-friendly,’ lawsuit claims
The lawsuit claimss that Blue Ice vodka is not actually handcrafted as the company claims.
The plaintiffs argue that the vodka is produced in a large, automated facility capable of producing millions of bottles per year, which contradicts the “handcrafted” label that suggests small-batch, artisanal production.
The plaintiffs also allege that Blue Ice vodka is falsely advertised as having health benefits.
The lawsuit points to social media posts by the influencers that claim the vodka is low in calories and can help consumers stay fit.
The plaintiffs argue that these claims are not only misleading but also violate federal regulations prohibiting health claims for alcoholic beverages.
Sava and Pop claim they purchased Blue Ice vodka based on the misleading advertising and paid a premium for a product that was not as advertised.
They claim they would not have bought the vodka if they had known it was not handcrafted or fit-friendly.
The lawsuit seeks to represent a nationwide class of consumers who purchased Blue Ice vodka.
The plaintiffs are suing for violations of the Federal Trade Commission Act, state consumer protection laws and unjust enrichment.
They are seeking damages, including restitution and disgorgement of profits, and injunctive relief to prevent further misleading advertising.
