Bhu Foods class action lawsuit overview:

Bhu Foods misbrands and falsely advertises its protein cookies as containing more protein than they actually do, a new class action lawsuit alleges.

Plaintiff Steven A. Cabrera filed the class action complaint against Laura’s Original Boston Brownies Inc., doing business as Bhu Foods, on Feb. 5 in California federal court, alleging violations of state and federal consumer laws.

Cabrera alleges Bhu Foods protein cookies — specifically the double dark chocolate and chocolate chip flavors — are misbranded and falsely advertised. 

He claims they feature deceptive protein values on the front label and misrepresent the percent of recommended daily value of protein contained in each serving.

Bhu Foods cookies contain only low-quality protein, lawsuit says

Cabrera claims Bhu Foods’ protein cookies’ labels mislead consumers into believing the products contain fully bioavailable, high-quality protein, when in fact they consist of low-quality proteins with poor bioavailability.

According to the Bhu protein cookie class action lawsuit, the percentage Daily Recommended Value (DRV) must be “equal to the actual amount of protein (gram) per serving multiplied by the amino acid score corrected for protein digestibility.”

The Bhu protein cookie class action lawsuit argues that consumers have a reasonable expectation that products should disclose the actual amount of bioavailable protein per serving as claimed on the front of the package.

Cabrera wants to represent a nationwide class of consumers who bought Bhu Foods’ protein cookies during the applicable statute of limitations period. He is demanding a jury trial and requesting declaratory and injunctive relief and an award of actual and other damages for himself and all class members.

A similar lawsuit alleges that Snack food company KIND falsely advertises the amount of protein in its snacks by up to 20 percent, as revealed by amino acid testing results.
