A Bertolli olive oil lawsuit has been filed in California as a class action against Deoleo USA, Inc. and Med Foods, Inc., the manufacturers of the popular product. The allegations in the Bertolli olive oil lawsuit state that several olive oil products were improperly advertised as being “Imported from Italy.” Other products were allegedly improperly advertising the olive as “Extra Virgin,” and some products advertised both claims.
The plaintiff in the California Bertolli olive oil lawsuit stated that several of the companies’ olive oil products “are not and never were ‘Imported from Italy.’ Instead, the olives are grown, and the oil is pressed, in various countries all over the world, including Tunisia, Turkey, Greece, Spain, Chile, and Australia.”
The Bertolli olive oil lawsuit goes on to state that these oils sourced worldwide are blended and bottled in Italy. There are state and federal statutes that prohibit companies from stating on the label that a product was imported from that country if the content of the product was only blended in the country or packaged in that country, the Bertolli lawsuit states.
“Common sense also dictates that Turkish or Chilean olive oil does not somehow become ‘from Italy’when shipped to Italy. Yet until after this case was filed, Deoleo systematically used this misrepresentation to dupe consumers into paying a premium for oil falsely labeled as Italian,” the Bertolli olive oil lawsuit states.
In addition to its alleged deceptive advertising about the country of origin of the olive oil in the product, the Bertolli olive oil lawsuit also takes issue with the advertising claim on the label indicating that the product is “Extra Virgin.”
The plaintiff stated two main reasons that the olive oil is believed to not be “Extra Virgin”: the blend of oils used in the product contained refined oils in addition to the extra virgin olive oil, and the bottle used for the olive oil products is clear and lacks UV protection, allowing the olive oil to be exposed to both heat and sunlight which ultimately causes the oil to oxidize, degenerate and degrade.
