A Florida man has filed a lawsuit against the manufacturers of a popular drug used to treat hypertension after he suffered severe Benicar digestive problems leading to personal injury.
Plaintiff Joseph N. is a 60-year-old man who began taking Benicar in 2012, according to his lawsuit. He claims that he sustained injuries including but not limited to dehydration, diarrhea and tinnitus as a result of ingesting the hypertension medication. He names Daiichi Sankyo, Forest Laboratories and their related companies as defendants in his lawsuit.
Joseph’s lawsuit alleging Benicar digestive problems joins nearly 2,000 others in the multidistrict litigation underway in New Jersey federal court. Because there were so many lawsuits against the product manufacturers stating that the plaintiffs developed Benicar digestive problems, the Judicial Panel on Multidistrict Litigation consolidated the lawsuits in order to streamline the judicial process.
By consolidating the lawsuits into a multidistrict litigation, pretrial discovery proceedings can take place in represent the group of lawsuits, thus conserving personnel, financial resources and time. This also assists in reducing conflicting rulings that may come out of individual courts.
Joseph has brought forth a number of allegations against the defendants including products liability for design defect and failure to warn, negligence, gross negligence, negligence per se, negligent design, negligent misrepresentation, fraudulent concealment, constructive fraud, fraud, breach of express and implied warranties, unjust enrichment, violation of consumer protection law the state of Florida and punitive damages.
The plaintiff is seeking judgment against the defendants and is seeking compensation in the form of punitive damages, compensatory damages, interest, costs of suit and any other relief deemed equitable and just by the court.
The Benicar Digestive Problems Lawsuit is Case No. 1:17-cv-04837-RBK-JS and is part of the Benicar MDL In Re: Benicar (olmesartan) Products Liability Litigation, MDL No. 2606, in the U.S. District Court for the District of New Jersey, Camden Vicinage.
Benicar Digestive Problems
The Benicar digestive problems reported by patients range from mild to severe. Many of the problems are linked to a condition known as sprue-like enteropathy. This condition mimics celiac disease. But with sprue-like enteropathy, patients are not experiencing severe digestive distress in response to gluten, a protein found in wheat, barley and rye. Rather, the specific type of enteropathy related with Benicar appears to be induced by the drug itself.
Severe problems can result from chronic diarrhea, which can also be linked with severe malabsorption and malnutrition. Dehydration is also common, especially in the presence of chronic diarrhea. With all of these conditions, patients may suffer such severe complications that they must be hospitalized in order to treat the dehydration and malnutrition.
