  • Who: Consumers recently filed class action lawsuits against Mielle Organics, Procter & Gamble and Dr. Squatch LLC. Charlotte Tilbury Beauty recently agreed to a class action settlement, and Drunk Elephant issued a product recall. 
  • Why: The consumers filed the beauty class actions over hair loss and false advertising. Drunk Elephant initiated the beauty recall due to an ingredient mix-up while Charlotte Tilbury agreed to the beauty settlement to end claims involving Illinois biometric privacy law. 
  • Where: The beauty class actions were filed in Illinois and New York federal court. 

Consumers recently targeted beauty companies with class action lawsuits involving hair loss and false advertising. A beauty company also initiated a recall over an ingredient mix-up, while another agreed to a class action settlement involving Illinois biometric privacy law. 

Class action says Mielle Organics failed to disclose products may cause hair loss

A group of consumers filed a class action lawsuit against Mielle Organics and Procter & Gamble earlier this month over claims the companies failed to disclose that Mielle Organics’ rosemary mint hair care products may cause hair loss and other injuries. 

The class action lawsuit argues Mielle Organics, which Procter & Gamble owns, also misrepresented that its rosemary mint hair care products were safe. 

“The products contain ingredients that cause and have caused hair loss and other injuries in its users, including plaintiffs and those in the proposed class,” the Mielle Organics class action says.

The consumers argue Mielle Organics would have discovered the rosemary mint hair care products contained ingredients that cause hair loss if they adequately tested them. 

Mielle Organics rosemary mint hair coil causes hair loss, class action claims

A consumer filed a similar class action lawsuit against Mielle Organics and Procter & Gamble last month over claims the companies’ Mielle Organics Rosemary Mint Scalp & Strengthening Hair Oil causes hair loss.

The class action lawsuit argues Mielle Organics and Procter & Gamble misled consumers by promoting the rosemary mint hair oil as safe and failing to disclose the harmful side effects. 

The consumer claims the hair oil caused her and other proposed class members to suffer both financial losses and emotional damage.

“No reasonable consumer would have paid any amount for a cosmetic product that contained ingredients causing hair loss or containing a high risk of causing hair loss,” the Mielle Organics class action says.

Dr. Squatch falsely advertised products as sulfate-, paraben-free, class action says

A consumer filed a class action lawsuit against Dr. Squatch LLC in October over claims the company falsely advertised several varieties of its men’s shampoo and conditioner products as sulfate- and paraben-free.

The class action lawsuit argues at least 15 of the 24 ingredients in the Dr. Squatch hair care products listed in the complaint are not “natural” as understood by consumers. 

“The products are ‘misbranded’ and misleading because despite the labeling and marketing as ‘Men’s Natural Shampoo’ and ‘Men’s Natural Conditioner,’ when water is excluded, its total volume is mainly non-natural ingredients,” the Dr. Squatch class action says. 

The complaint names Dr. Squatch’s Pine Tar, Fresh Falls, Cool Citrus, Summer Citrus, Cool Fresh Aloe, Coconut Castaway and Frosty Peppermint varieties of men’s hair care products. 

Charlotte Tilbury Beauty to pay $2.9M to end BIPA claims

This month, Charlotte Tilbury Beauty agreed to pay $2.925 million to end claims the cosmetics company violated Illinois biometric privacy laws by collecting facial geometry scans from its  website visitors.

The settlement benefits a class of consumers who used a beauty technology tool or any other virtual try-on tool for a variety of products on the Charlotte Tilbury Beauty website and/or mobile app in Illinois between Dec. 1, 2019, and Aug. 31, 2023. 

Individuals who want to join the Charlotte Tilbury Beauty class action settlement must submit a valid claim form by Jan. 2, 2025. 

Drunk Elephant recalls skin care products over ingredient mix-up

Drunk Elephant issued a recall for certain lots of its skin care products last month over concerns of an isolated ingredient mix-up

The recall involves some lots of Drunk Elephant Beste No. 9 Jelly Cleanser, Protini Polypeptide Cream and Lala Retro Whipped Cream skin care products, including sample packets of Lala found inside O-Bloos Rosi Drops cartons.

Drunk Elephant says the recall is due to an isolated ingredient mix-up between preservatives and surfactants during production, compromising the formulation of the skin care products. 

Consumers who own the affected products should stop using them. Drunk Elephant is offering full refunds and replacements.

    My lungs have been terrible for the last 20 years. All the perm chemicals hairspray and bleach and dying hair has caused me to have COPD AND PNEUNMONIA AT LEADT 6 TIMES IN 2012 TO 2013 WHICH LEFT MY LUNGS IN TERRIBLE SHAPE. ARE THERE ANY LAWSUITS FOR YHAT. IF NOT THERE SHOULD ME. I WAS 16 WHEN I GOT IN THE BEAUTY BUSIMESS AND NO ONE EVER SAID BACK THEN THAT ALL THE CHEMICAKS WERE BAD FOR YOU. PLEASE LET ME KNOW IF I WUALIFYY FOR ANY VOMPENSATION
